need advice po sa nullity summon with in 15 days

good day po ako po ay manghihingi ng advice po tungkol sa aking sitasyon. kami po ay kinasal nuong december 2003 ng aking asawa na nagtungo ng taiwan. nuong time na iyon ay may alitan kami at matagal bago sya nag paramdam at sinasabi nya na meron na syang boyfriend at masaya na sya. so pinabayaan ko na sya at ako ay nagpatuloy na mamuhay ng tahimik. after mahigit na 8 taon ako ay nagulat ng may dumating na summon sa aking civil case for declaration of NULLITY OF MARRIAGE na gawa ng aking asawa. ang nakasad dito ay within 15 days na hindi ako maka reply the plaintiff will take judgement by default and may be granted the relief applied for petition.

ako po ay nakabalita na sya ay may kinakasama na at may anak narin marahil ay gusto na nilang magpakasal.

ako po ay walang balak tumutol sa gusto nilang magpakasal, ako lang po ay nangangamba na gumastos din sa sinasabing nullity of marriage case na nakasaad sa summon.. ako po ay isang minimum salary na employee at wala pong ganung halaga na maibibigay.. at ako po ay nasa MANILA at ang SUMMON ay gaganapin sa SAMAR RTC.

hindi ko po alam kung anu ang gagawin at natatakot baka pag di ko na sagot ang summon within 15 days ay saakin nila ipataw ang gastos.

parang awa nyo na po anu po ang gagawin ko... salamat po ng marami sa pag tugon..

Sir, the summon is part of the due process of the nullity of marriage. Pag di ka nagreply they will proceed. May marereceive ka pang isang notice called pre-trial notification. However, the case may be granted even without your appearance. A nullity of marriage maybe granted 6-12 months. If you don't want to attend the hearings its fine. So pra mkibalita sa nging court decision, check your NSO Marriage Certificate after one year. Smile

ikinasal kami sa  simbahang katoliko more than 30 years ago.   Lately lang ay nalaman ko na nag convert sa Muslim ang asawa ko at nagpakasaal sa isang babaeng Muslim kung saan ay mayroon siyang kambal na anak. nagfile na ako ng legal separation at wala siyang balak na sumagot sa aking petition. Anong mangyayari sa ganitong sitwasyon?

Balak kong sampahan sila ng bigamia. may hawak na akong marriage certificate galing NSO kaya lang napansin ko , ung first page walang signature kahit isa- ung husband and wife , immam at sponsors lahat walang signatures. sa second page lang meron ung tungkol sa talaq. un ang may signature ng asawa ko at ng girl. is this valid? wala ding License at affidavit from Sharia ang marriage certificate.
Pwede ba ang ganito sa bigamia?

maybe you should discuss this with your lawyer? inquire how the husband can be declared in default so you can present your evidence without him.

inquire also about filing bigamy by presenting both marriage contacts and leaving it up to them to prove that he converted to islam in good faith
