Received subpoena from City Prosecutor's Office

Help naman po. Nakareceived ako ng letter from City Prosecutor's Office sa Butuan. Eh taga Manila ako. Nagulat ako dahil same person ang nagpadala ng letter. Estafa worth 2,500.00 ang involved. I was invited to go there pero ang layo eh. So ang ginawa ko refused to received ang letter.

I remember August 2011 I met a friend a common friend na nagbebenta ng items sa isang online shop. Nagfavor kung may valid ID ako to remit the money. Sabe ko I have, bigyan nya na lang daw ako. Then we went sa LBC within Manila to pick up the money. Ayun I dont know kung para saan yun. As far as i know, wala na siya sa sarili nilang house. Then I found out na nag-iscam pala siya. Kaya yun naka receive ako ng letter from NBI and City Prosecutors Office.

Tama ba? I spoke to a lawyer, He advised me na dismissable ang case:

1) Text message is not enough para maging evidence against me
2) Yung jurisdiction ko. Nasa Manila ako then siya nasa Butuan. Dapat daw mag file siya ng complain sa Manila or kung saan nakuha yung money
3) Hindi naka-indicate kung para saan yung money papadalhan sa LBC


Help naman po. I want to clear this out. Kung hindi ko mahanap friend ko na yun, baka naman okay for mediation yung nagpadala sakin. Kawawa nmana eh.

if you dont file a counter affidavit, it will be resolved based only on the statements and evidence of the complainant. you can prepare a counter affidavit, swear before it to a prosecutor here then send it to butuan. ignoring it would be the biggest mistake especially if it was endorsed by the NBI

Thanks Atty. Pero nauna muna yung NBI to send me a subpoena to me eh. then after SIX months nagpadala naman ang city prosecutor's office ng subpoena. I messaged (complainant) for a settlement para matapos na. pero i havent received any feedback from her.


I asked my lola's attorney about it. Correct me if I'm wrong.

1)Usually, if someone will send me a subpoena from City Prosecutor's Office, yung envelope ng letter is either yellow or brown like sa brown envelope. But the thing is wala siyang envelope.. naka.staple lang siya like sa NBI.

2) Nauna muna ang NBI magpadala ng letter. Estafa ang case. Di ba dapat sa Cybercrime Unit ito manggagaling? Ang Estafa is something about issuing a post dated check?

3) I sent her a letter thru Facebook yung sa side ko naman. And suggesting for a mediation/settlement. Pero I was thinking baka isipin nya it's really my fault. Nagpunta na siya ng Manila, why don't even bother to go to Manila Police to file a case or visit my house for possible confrontation...

I was thinking na gawa gawa or tinatakot lang ako.


Pero ang sa akin lang, I want to clear this thing up. I am open for mediation. I did my part, pero no other words from her end.

i highly recommend you send a counter affidavit to give yourself a chance. next will be a resolution and then warrant of arrest. worst thing you can do is to ignore it.
