Magandang araw po. Nag resign po ako sa company ko at walang maayos na resignation o clearance dahil d ko tinapos yung pakiusap ng boss kong tapusin yung 30 days bago umalis. 15days plang umalis nako kasi me interview na ko sa bago kong company. After 4months Kumuha po ako ng nbi kaso biglang "hit" at first time lng pong naging hit ako. Ano po ba ang consequences kasi sabi ng dati kong kawork mag pafile daw po ng kaso sakin ang dati kong employer. Saka ano po ba ang collective cases?

Kapag my 'hit' ka sa NBI Clearance mo e kailangan mong bumalik sa NBI at klaruhin kung anong 'hit' iyon. Usually, Kung 'hit' iyan ay may kaso o kapangalan ka na may kaso. MAgkakaroon lng ng 'hit' kung my nakasampang kasong KRIMINAL laban sa isanag tao.

Collective cases, ang ibig mo sigurong sabihin ay collection cases. Ito ay may koneksyon sa pagsisingil ng pera. Ito ay Civil Case at hindi Criminal Case at hindi sapat pra malagyan ng 'hit' sa NBI ang isang tao.

I suggest bumalik ka sa NBI at itanong mo kng bakit ka may hit. Good Luck.

Plan ko po mag resign sa work ko 5 years na po ako dito, gusto ko naman po itry sa ibang company. If mag file po ako ng resignation letter need ko po mag render ng 30days. Medyo malabo po kasi na payagan ako dahil medyo mabigat narin ang responsibilidad ko sa office. What if they will not approve my resignation? can i still pursue it?
May right po ba sila na pigilan ako?

Walang karapatan ang sinuman, maski presidente pa ng Pilipinas, na pigilan ka kung gusto mo mag-resign.

Hi po hingi lang ako ng konting guidance..just recently nagfile ako ng 30days notice of resignation,it was approved by my supervisor.Na render ko na halos yung days pero may natititra pang 5 days before yung effectivity of resignation ko.My problem is that Hindi ko na macocomplete yung 5 days dahil kelangan ko umuwi ng province because my mom is in the hospital and is critical.she got no one but me.ano po ba possible consequences ng Hindi ko pagtapos sa 5 days na yun?

Magpaalam ka ng maayos at baka payagan ka naman.

Mas mabuti kung makapagpakita ka ng papeles galing sa ospital para patunay sa sitwasyon mo.

Pwede silang humingi ng damages ayon sa nakasulat sa Labor Code dahil sa hindi mo pagtupad sa 30 days notice.

tatanong lang po ako,.nagtraining po muna ako ng 5days tapos nahired po ako as teller sa isang agency feb.17,2016 dahil po sa nature ng trabaho ko at mdyo nahirapan po ako dahil lagi akong nakakapagabono,dahil po siguro wala pa ko experience sa ganung trabaho.,nag AWOL po ako,last day po na pinasok ko e March 4,2016.,ung training ko po na 5days e my allowance daw po un na 150 per day..tapos po ung unang cut off e nasama po ung 3days na pinasok ko..tapos po sa pangalawang cutoff na feb.20-march.4 e napasok ko din po bago ako ng AWOL..pero sa lahat po ng pinasok ko na un kasama po ng training ko e wala po akong sinahod sa kanila..nung hindi pa po ako ng AAWOL ang huling sabi po sken ay ibibigay daw po ung 5days training allowance ko kasama ng 3days na pumasok aftr nila mag cutoff simula nung nag start ako,march.15 daw po nila ibibigay,.since wala po silang pinafillupan sken na form for atm wala po way para po makuha ko pa ung lahat ng pinasok ko kasama po ung feb.20-march4 na nilakaran po na pumasok pa ko,ung feb.20-march4 daw po kasi na DTR e march 31 pa po ang payout nila...tanong ko lang po attorny wala na po ba talagang chance na makuha ko po ung dapat po na sahod ko sa lahat ng pinasok ko sa kanila???..ano po bang magandang step ung gawin ko...sana po matulangan nyo ko.salamat po

Hingi lang po ako sa inyo ng advise, Nag work po ako sa Spraying Systems company sa pilipinas ng 4 1/2 yrs as a sales engineer. May pinirmahan po ako contract sa kanila na if ever na aalis ako sa company di po ako pwede lumipat sa direct competitor nila. Meron po ako mga binayaran sa company na products worth 9,000.00, meron din po kami na performance incentive bonus na makukuha kapag na complete mo yung 1 full term of each year. Umalis po ako sa company last 23 January 2016 para po mag work sa ibang bansa, nag iwan po ako ng resignation letter sa HR namin at sa table ko. Binalik ko din po lahat ng issue sakin ng company. di na po ako nakapag render ng 30 days, nag follow up po ako sa HR namin para dun sa backpay ko at incentive bonus, pati dun sa days na pinasok ko from 15 January 2016 bago sa pag alis ko. Sinabi po sakin ng Manager namin na wala daw po ako makukuha kahit ano kasi di daw po ako nag render ng maayos. Kung gusto ko daw po makuha yung para sakin need ko daw po bumalik sa office at mag render. 2 yrs po contract ko sa ibang bansa, bale 2018 pa po ako makakabalik, then may mga issue din po na sakin sinisisi ng boss ko yung nangyari sa project which is di ko naman po yun kasalanan. Anu po ba ang maipapayo nyo sakin pag ganito ang sitwasyon.

good morning po, ask ko lang po, college faculty po ako ng isang educational institution, hindi ko na po nagustuhan yng pamalakad nila kay naghanap po ako ng work, natanggap ako sa isang corporate supervisory work, nagpaalam ako sa skul namin at nakipag negotiate ako na kng pwede sa gabi ko nalang klasehan ang mga studyante ko since mag work na ako during daytime, ayaw pumayag nang dean namin, pero umalis ako, inAWOL nya ako, kapag AWOL po ano po ba ang pwede lang ihold ng company? ayaw kasi ibigay ang 13th month ko at Withholding tax refund ko. ano po ba pwede kng gawin? salamat po sa advice

Ang pagkakaintindi ko Jerry ay hindi ka nakakuha ng clearance from your employer dahil hindi fully satisfied ang iyong resignation like 30 day clearance, possibly kaliwanagan sa next employment mo and other HR matters. Suggest ko deal with the requirements so you can get a formal clearance. You will need this in the future. Baka kaya ng pakiusapan via email or thru your assigned representative sa Pilipinas.

Hi Attorney,

Tama po di ako nakapag render ng 30 days bago umalis papunta ibang bansa. Nag pasa po ako ng resignation 1 day bago ako umalis. Possible padin po ba yun na after 2 years saka palang ako mag render ng 30 days para makuha yung claim ko? May mga ganito na din po ba kayong scenario na na encounter?

Wala nang silbi ang pag-offer na mag-render ng 30 days dahil sa sobrang tagal mo nang nawala.

Magdududa din ang employer nyan at baka isipin na kung ano ang gawin mo pa sa 30 days na yun.

Subukan mong humingi ng computation at detalye kung bakit wala ka nang matatanggap. Basahin ang iyong kontrata tungkol sa pagtupad sa nakasaad na pag render ng 30 days.

Ayon sa LC pwedeng humingi ng danyos ang kumpanya dahil sa hindi mo pagtupad sa nakasaad sa iyong kontrata patungkol sa resignation notice.

Kapag in-AWOL ka, wala silang pwedeng i-hold and ayon sa batas ay para sa iyo. Pwede mo hingin ang COE, Back PAy (kasama ang 13th mo pay mo), Clearance mo. KUng di nila ibigay ay pwede ka mag-file ng complaint sa DOLE.

Pwede ka nman nilang i-terminate ka for job abandonment.

Hi po! I just need an advice for my brother. My brother is currently working as a senior safety engineer in a construction private company. His work is far away from us and we didn't see him for almost a year now. He's been working without day off because he has plans to save it for my graduation day and for our parents anniversary (MAY2016). Now that both events are near, despite that their project will ends in AUG2016, he passed a leave request to his boss because he wants to have a vacation and to be in my graduation day and our parents 25th wedding anniversary. He makes 4th attempts but his boss did not approved it. For the last attempt he passed again a leave request and now waiting for the boss decision. If it will be rejected again, my brother plans to have an AWOL. He don't want to leave his company or resign, he just don't have a choice. He is planning to have a 1 week vacation and will return to the company after that. Do you think its ok if he do the AWOL thing? I really need an advice. Im in a dilemma right now because its either we can be with him in the special day of my parents and my life or he will be unemployed when he return. Do you think this AWOL can really affect his job? Thank you!

Since na reject na yung application for leave nya if you pursue this course of action pwede syang kasuhan ng insubordination. That can be grounds for termination

Good Day atty.

what is the best thing to do. here's the situation,
I just turned 1 month in my new office. I am under an agency then few days ago I received an offer from a different company offering a much better compensation plus Direct employment. I submitted my resignation letter a very short notice (1week).
In my contract there is a statement "if the contractor abandoned her job, she will be liable for damages and loss not less than 100k";so I clarified this and they said "unless I resigned or informed the office for the resignation, contractor will not be liable for the damages". Also not stated in the contract that I should render 30 days.

what I told the agency is that , just let me go and I will still be rendering hours/days here without pay just let me leave the company.

what should I do.?
