hi atty. Last Friday morning, hindi ako nakapasok sa trabaho dahil sa LBM. Unfortunately, hindi nako nakapag inform na hindi ako makapasok dahil bago pa lang ako sa office but at the afternoon, pumasok naman ako agad dahil mabuti ng pakiramdam ko at nagpaliwanag naman ako sa dahilan bakit ako nakapag absent. pero INAWOL nila ako sa half day ko.
Can I complain against it atty?

mAG tanong lang po, nag awol po ako sa work ko, pero under ako ng agency my policy sa agency na may cash ban ka para daw kapag umalis ka meron kang makukuha..

can AWOL employee get his last pay? i have almost a month of work that hasw not yet been paid my managers not signing my clearance because im AWOL na daw. nagpaalam nmn ako na uuwi ako ng province dahil namatay lola ko pro di sya pmayag. and 2 weeks nko d nakapasok. he said im AWOL. nung bmalik ako i go to HR binigyan nla ko ng clearance. I go to the store to let my manager sign for it. he said bigay ko nlng daw s supervisor ko. which i do so kaso sabi nla iwan ko nlng daw.

3 months from now nag follow up ako sa back pay ko, gulat nlng ako di daw narecieve clearance ko ng HR. bmalik ako s store to confirm. sbi ng manager ko, AWOL daw ako, bakit daw nya sisign clearance ko. i was frustrated kailangan ko yung pera manganganak asawa ko. umaasa ko na makukuha ko last pay ko ngayong buwan. pero hindi pla. may 2 cut off pa ko na hindi bayad. i dont care if di na nla ibigay 13th month ko basta byadan nla mga pnasok ko..
atty. do i have the rights on this even if AWOL ako, pwede ko pa ba makuha mga pinasok ko?

Hi Atty.

Hihingi lang po sana ako ng advice nag work po ako sa isang company for 2 and 1/2 years ngaun po meron po ako nagawa againts sa company. Gumamit po ako ng company phone as my personal use. Nacharge po ako then nung mag file ako ng resignation pina extend po ng 60 days and 4days palang po ako nung mag resign at payday na wala po ako nareceive na sweldo. Sumama po loob ko kasi po inamin ko naman po at nangako magbabayad nung charges ko eh biglang di nila ako sinuwelduhan ng walang sabi2x. kaya nag AWOL ako. Ngaun po after 3weeks nakareceive po ako ng letter stating that They file a record on DOLE that I'm already awol and they will file a case againts me. Ngaun po may new work ako at kelangan ko ng requirements.. Kaso po mukhang malabo ako makakuha ng mga records ko sa prev. Employer ko dahil sa nangyari.Anu po ba maiiadvise nyo thanks po

eugene, there is no legal right to a clearance, but you can file a money claim at nlrc for unpaid wages

angeline, find a way to pay back your debts immediately if they will allow it so you can get a clear exit

Ask ko lang po. Paano po kung magre-resign ako and gusto ko po na sa isang buwan pa (April 26)(following yung 30-day rule). Pero I submitted na yung resignation today, March 26,2013.

The HR said na pwede na nila ako bigyan ng early exit since wala na akong schedule ng klase ( I am an online ESL teacher).

Pwede po ba nila gawin yun kahit na yung nasa contract ay 30 days na notice for resignation?

Hi atty!

I need help. im currently employed in a japanese firm based in our country and im planning to go awol because i cant pay for my bond. i no longer see myself happy doing my job so i want to leave. but im scared that it may cause that my license will be revoked/suspended. my question is, what will be the worst case scenario for us licensed professionals if we go awol? and how do foreign companies deal with them? do they report to PRC or any sort? thank you. im just so lost right now. thanks for the immediate answer.

moderator
i recommend you file a proper resignation. going awol, they may seek damages and a complaint at prc. whether they actually do so depends on them.

as for bonds, search 'employment bond' in the forum

Matanung ko sir bat di ka na happy at you are considering to resign na? Me demotion ka ba sa position? Me maltreatment na ba ang management at mgatao sa work sau? If so, pwedeng maging constructive dismissal yan kung yan ang rason na ilalagay mo mismo sa resignation letter mo.

About sa AWOL, pwedeng mareklamo ka at makasuhan ng civil sa damages at macomplaint sa lisensya mo. So medyo, matindi yan kung hahabulin ka ng company mo. Though, me separation pay ka naman nyan kung sakali. Pero madami damages sayo at mahirap na sitwasyon yan.

Obligation mo po sa batas na magrender ng at least 30 days notice sa company. Kung mapapaaga itu at yan ang approved ng management mo, e pwede at legal yun.

Unang letter pa lang ba yan from the company? Sa abondonment kasi na case, dapat makatatlo na send ang employer sayo ng letter ordering you to return to work (RTW) saka lang nila masasabi abondonment ka at makapagfile sila sa DOLE.

Kung kinaltasan ka nila ng sweldo or di ka nila pinasweldo based sa ngyari sa phone, e dapat inde nila gawin yun. Illegal yun. Bago ka mabawasan sa sweldo ng phone bills, e dapat me pipirmahan ka na authorization letter na magdededuct sila sa salary mo. Pwede mo itung gamitin na dahilan para magfile ka ng CONSTRUCTIVE ILLEGAL DISMISSAL since sabi mo yan ang dahilan ng resignation mo.

Nakapagwork na ako ng walang clearance sa isang company. NAkadepende yan sa HR at Boss mo. Kausapin mo ang current company mo ng maayos at makiusap pa. Magfile ka na din ng case mo for CONSTRUCTIVE ILLEGAL DISMISSAL. Pwede ka makakuha ng separation pay sa 2 1/2 yrs na tenure mo na halos 3 mos ng sweldo mo yan.

Maliit na dahilan lang ang phone bills. Ang abondonment dapat maprove nila na nagfollow ng 3 na notices sayo.

3. Saka ang burden to prove na malaki damages ng pag abondonment mo due to absences, ay nasa kanila. The fact na nasagot ka at natawag sa knila for the absences, e mabuti intention mo na bumalik sana ng work.

You can win the case. I file mo na sa NLRC.

Nagtatrabaho ako for a company ran by Japanese and Filipino incorporators. I filed a resignation letter effective after 8 days. The general manager requested for extension dahil kailangan pa daw niya ang serbisyo ko. So we agreed on having my employment terminated after 23 days, pirmado na ang resignation letter ko. Ang problem, there was this important company meeting where they announced na it's for eveybody to attend. Pero it turned out na hindi ako invited. i think i was deprived of my right to be in that meeting, worse is that ang dahilan na ibinigay sa akin ay hindi invited ang mga nag-file ng resignation, problem is, merong ibang employees who filed their resignation, even ahead of me, pero nandoon pa rin sa meeting. So, obviously, hindi reason yung pagfile ko ng resignation sa non-invitation to that company meeting. At sa dahil nga ayaw ko nang madawit pa sa mga pwedeng gawin pa sa akin, sinubukan kong itulak yung dating effectivity ng resignation ko, para makaalis na ako agad, pero hindi pinayagan. Are the circumstances mentioned enough for me fight for an immediate resignation, para hindi ako mag-AWOL? Or if ever they come after me after becoming AWOL, pwede ko bang ipresent yung irregularities sa company na nag-udyok sa akin na mag-AWOL? Thank you po

chizzy, whether you should be included in a meeting is a management prerogative. based on your narration, i don't consider it a basis for immediate resignation.

Hi. I had an employee who i considered not as a regular worker, because he comes to work whenever he pleases.There are times that he does not come to work for weeks at a time.He has been warned to ask permission several times.A month ago, he did this again and returned to work without notice.So i dismissed him.Now i have a letter from DOLE for illegal dismissal and other offenses.Was it illegal for me to terminate him?

hi atty.
i am an officer of a company. i filed my leave three weeks before my scheduled leave... two weeks before my leave, my boss informed me that im not yet entitled to a leave because i just got regularized.  i approached the personnel about this, and they told me that i am already entitled. so i asked again my boss, this time, a week before my leave, she told me that there's a memo about taking leaves on days in between holidays and weekends.  i again approached the hr about this, and they said they will look into it.. i am not aware of any memo, and neither was it being implemented to my co-officers, as a matter of fact one of my colleagues filed her leave in between Christmas and the weekends... i will push through with my leave.  what are the possible consequences of my actions.

good day, may husband and I are in the same company for about 9 years. ang problema po, nagpaalam po kami sa boss namin na mag leave without pay for 3 days kasi nga magpapabinyag kami ng baby namin sa probinsya. hindi kami pinayagan na mag leave without any some reasons kung bakit. tapos sabi niya sa amin AWOL daw kami. paano po nangyari yun atty? kung tatangalin kami sa work namin ano po kayang legal na action ang gagawin namin.

Hi Atty,
Nagwork po ako sa isang CC for 1yr. At natemporary layoff last Nov16. Tapos pinabalik kami ng Dec13.
Unfortunately, hindi po ako nakapasok.
Dahil una, hindi ako nakatanggap ng text nila dahil nawala cp ko at nagbago ng number. (Nalaman ko lang sa kasamahan ko)
Pangalawa, nasa malayong lugar ako.
Pero nagnotify ako sa boss ko.

Tapos Dec16, hindi ako ulit nakapasok dahil may sakit. Pero nagnotify ulit ako. Pero Terminated na daw po.
Pumunta nalang daw ako sa office para magpaclearance.

Pag punta ko ng office,
AWOL daw ako kaya hindi ko matatanggap last pay ko at 13th mo.

Nagpadala daw sila ng letter kaso lumipat na kami ng bahay kaya hindi ko natanggap.

Consider bang AWOL kung nagnotify naman ako?
At wala bang matatanggap na kahit ano pag AWOL?

If your terminated for just cause, you are entitle of the ff:
last pay (including holiday pay)
pro-rated 13th month
tax refund (if any)

Whom did you ask permission to be absent? Did he allowed you to be absent? Notified and permitted are two different thing
