I emailed my resignation letter last oct 15. and this is my reply on the same day:

Hi Richard,

Your resignation is accepted. I noticed your last day is October 31st.
We normally request a 30 day notice to transition and identify a
replacement resource to avoid an impact to our operations. Let me know if
you can extend to Friday, November 14th to support our team on the
delivery of Phodi.


then sabi ko is i'll confirm kung available pa ako until nov 14th. And then last Monday Oct 20 nag verbal confirm ako na hindi na ko pwede mag extend the answer was "Okay, we will just manage". Then just yesterday nagbago isip and I am being pressured to extend or hindi ako bibigyan ng clearance

So ibig sabihin kahit pumasok pa ko hanggang 31st no pay na ko dahil wala ako clearance?

I tried talking to them to meet half way, maybe work from home since IT naman kami. Ayaw gusto talaga mag extend.

Hello Atty.

My previous employer filed a case against me as AWOL but I have not signed any contract with them. They they filed a case against me their atty submitted a demand letter to my previous school.

If ever i will fight them in court, is there possibility of winning the case since I have not signed any contract?

If they can show any proof that you actually worked for them, then that's a point for them.

But is it not illegal working with them without statutory benefits? I worked with them for 1.5 months waiting for contract signing but they have not given me any. Then, they told me they still have the right to file a case against me as I am under probationary for 6 months. Is they possibility of winning if ever i will fight them? That is the main reason I quit my job, i got no statutory benefits.

So go to DOLE, SSS, BIR and PAG-IBIG to file a complaint against the company.

I was dismissed from work due to Acts against good conduct and behavior specific to
1. Sexual Harassment
2. Improper conduct and acts of disrespect while performing official duties outside the company

Is it right that the only panel during the admin hearing was the Director of Operations and HR Manager and me? What is CODI?

It was an immediate termination. It was served to me July 16 and effective on the same day. Is there any violation?

I went to DOLE to report the issue but it was not discussed to me properly but they are trying to mitigate the issue.

Company is asking me about the settlement or financial assistance. How much claim should i ask? If ever that case will push through to the court and just incase we win the battle, how much will I get?

Good day atty. Im working po sa semi government office in qc, .im working there since 2001 contractual po ako, na permanent po ako may 2005 up to present dun po ako nagwowork, nagstart po problem ko ng biglaan deduction sa salary ko without prior notice sakin, staggered basis po deduction nila sa late's/tardiness ko, leave without pay nadaw po ako sabi ng oic namin kaya dinededuct lahat ng lates ko, pero i accept po kahit deducted salary ko, ngyun po sa inis ko sa knila umabsent po ako almost 1 month, den may dumating po sakin letter dated july 15 nakasaad po sa letter to return back to work immediate kaya po nagreport ako ulit sa kanila, den gumawa po ako letter asking for apology dun sa 1 month n absent ko tinanggap naman po nila, eto na po un pinasok ko sa kanila july 16 to 31 ay wala daw po ako sahod kzi daw po leave without pay nko, nung tinanung ko un oic namin savi po ganun nga na leave without pay na at wait un letter ng president namin, habang hinihintay ko po un letter umabot halos 1 week bago ko nareceived un letter na nakasaad na i have to submit within 48 hrs written explanations dun sa 1. Absent 2. Tardiness 3. Deleting files, sinagot ko thru written explanations nag pasa po ako answer sa kanila, ngyun po may laban po ba ako pag nag file ako sa labor kzi pati un performance and salary na pinasok ko ndi po binibigay sakin, and ndi npo ako nagrereport s kanila kazi po wala naman akonh sahod eh tulad ng savi ng oic namin, pls help me po tns in advance atty. hello Atty. tanong kung may legal basisi ba ung company na pinasukan ng anak regarding sa claim nila na dapat magbayad ang anak ng 18,553.68php sa company. Isang araw lang ang ipinasok ng anak ko sa company. Wala naman siyang nareceive na kahit na anong pera or benefit sa company. Bale parang lumalabas na nag awol ang anak ko. May tumawag dito sa bahay namin na taga company na pinasukan ng anak pero di nakausap ang anak ko . Nag return call naman ang anak ko sa HR office, at ipinaalam ng anak ko na wala na siyang balak ng magtrabaho pa kanila, but panay pa rin ang padala nila ng letter na telling my daughter to explain why she's not reporting for work. My daughter did not reply or send any letter to the company. Then she receive a demand letter from the company stating that my daughter should pay the said amount and if she failed to do so the company will resort to all legal remedies available to them. My daughter got alarm when she receive the letter. My daughter called the company, send e mail and text asking for a copy of the pay slip. Up to now she have not receive any reply from them. Ang tanong ko may habol ba ang company na pinasukan ng anak ko when in fact wala naman syang pinirmahan na payroll or na receive na salary sa company. Wala naman ding balak ang anak ko na singilin pa ung one day na ipinasok nya. Sana po matulungan nyo ang anak ko. Maraming salamat po. Me and my daughter is hoping and waiting for your reply. 1. Nagtrabaho ang anak ninyo. May pananagutan sya.
2. Isa sa mga dapat gawin ng empleyado bago umalis at magpaalam ng maayos.
3. Nasa batas na dapat magbigay ng 30 days notice bago umalis.
4. Nasa batas din na pag hindi nagbigay ng tamang pasabi (30 days notice) pwede syang ihabla at pwedeng humingi ng danyos ang kumpanya.
5. Ang mga sulat na pinadala ng kumpanya para magpaliwanag etc ay kasama sa proseso ng batas (due process).

Mali ang ginawa ng anak ninyo na basta-basta na lang umalis.

Nagwork ako for 4 months sa isang call center company. Kaya lang nung May 6 onwards hindi na ako nakapasok kasi for the past few months lagi na ko umaabsent due to health reasons. Nasa training period pa rin ako nun kasi 5 months ang training so yung trainer ko nakikipagcoordinate sa kin during that time. Sinabi ko na rin sa kanya na balak ko na magimmediate resignation. Ang gusto nila pumunta ako sa office para makausap ng HR. Kaya lang dahil nga may sakit ako nun at di ako fit magtravel di ko naasikaso at di ko naprocess ng maayos yung pagalis ko. Nung sinabi ko na magiimmediate due to health reasons hinihingan nila ako ng not fit to work. Nung nagtry ako na humingi sa doctor ko nun ayaw naman ako bigyan dahil di naman daw talaga pang not fit to work yung sakit ko. I just need some rest lang daw po for a couple of weeks. Since di pa naman ako regular at naubos ko na yung sick leave at vacation leave ko nagdecide na lang ako na magresign kesa naman lagi ako absent. Pero sabi sakin ng trainer ko di daw ako pwede mag immediate resignation due to health kung wala ako mapepresent na not fit to work. After nun di na po ulit ako kinontact. Ngayon ko lang po nareceive yung mail galing sa company na dated may 21 pa. Sabi dun na kelangan ko asikasuhin yung exit clearance ko at ireturn yung headset ko. Tinawagan ko yung trainer ko today para iverify sa kanyapano yung process ng exit clearance. Ang sabi niya sa akin di daw niya pinrocess yung exit clearance ko at tinag na awol. Yung mga kasamahan ko sa work na nagresign din same din ang problem. Pero yung friend ko na hindi man lang nagnotify sa TL niya at bigla na lang di pumasok nakakuha pa ng final pay. Please help. However, if at all possible, I would appreciate you releasing me from employment with the company on December 1, 2015." and pinagbigyan naman ako ng supervisor ko. Ang reason ko po is mageenroll ako sa review center for the licensure examination. Tapos ngaun po eh hinahanap ng supervisor ko ung resibo sa review center. kelangan pa ba talaga ipakita ung resibo?

Yes, they may ask for it.

Nagbigay ka ng dahilan para agahan ang pag-resign mo at pumayag sila... at gusto lang din nila talagang malaman na ang pag-aral ang totoong dahilan ng pag-resign mo.

Kung totoo naman na nag-enrol ka, walang mawawala sa iyo.

Kung nagsinungaling ka... ibang usapan naman yon.

1. Nag-enrol ka ba talaga?
2. Meron ka bang ibang katibayan na nag-enrol ka?
3. Kahit mag 30-days ka pa, dahil empleyado ka pa rin, pwede ka pa rin makasuhan ng pagsisinungaling at kung ano pang iba (kung hindi totoo ang pag-e-enrol mo).
