gudeve po..nais ko lang po sanang itanong kung legal po ba ang pagkaka-kasal namin ng asawa ko? kasi kinasal po kami nuong may 26 2002 na ang edad ko po nuon ay 17 lamang.ito po ay isang kasalang bayan,sinabihan po kami nuon na isasali kami sa aktuwal na kasalan ngunit hindi pa mairerehistro ang marriage contract dahil po sa 17 lang ako.kaya lang po ang nangyari nung umedad na po ako ng 18 at pabibinyagan na po namin ang panganay namin ng mga ilang buwan na lang ay pinaasikaso po sakin ito ng mr ko para maiparehistro.kaya ang ginawa po ng humahawak sa papeles namin ay kumuha sila uli ng panibagong marriage license at ng maiayos ng lahat ay ipinarehistro nila ito kasabay ng petsa ng naging kasalang bayan na ginawa sa lugar ng humahawak ng marriage contract namin,ang petsa po na naiparehistro ang marriage contract namin ay october 12,2003.nung minsan pong kumuha po ako ng kopya ng aming marriage contract sa local civil registrar ng quezon city ay nakakuha pa ako ng kopya at yun nga po ang petsang lumabas sa marriage contract namin na october 12,2003,ngunit sa NSO ay hindi pa po ako ni minsan kumuha.ibig sabihin po ba nito ay legal na naiparehistro ang aming kasal dahil nakakuha po ako ng kopya sa local cicil registrar? sana po ay masagot ninyo ang katanungan kong ito.
kami po ng asawa ko ay magsa-sampung taon na ang kasal ngayong taong 2012 ngunit gusto ko na pong makipaghiwalay sa kanya ngayon.maraming salamat po at umaasa po ako sa kasagutan sa aking tanong..

if you were 17, then the marriage is void. but it is presumed to be valid unless one of you files a case to annul it.

Hi, I got married in Hong Kong about 10 years ago and had a child 2 years into my marriage. I am now in the Philippines with my child while my husband is working overseas. I found out that he has a previous marriage and is not annulled. I would like to make things right by filing for a nullity of marriage or a legal document that says our marriage is void. How do I go about this? Do I file this in HK or in the Philippines? We are both Filipinos and I am a permanent resident of HK while he is not. Your advice would be highly appreciated. Thank you.

Hi Attorney!Magtatanong lang po ako ano ang dapat gawin sa case ko. Kinasal po ako ng 2004 and nagsama lang po kami in total ng 4 months. US citizen po kasi sya and during that time nagpakasal lang kammi sa pilipinas then he left na din. But bago po ang nasabing kasal meron po talaga akong boyfriend at alam po ng naging asawa ko yun. He knows na nagkaron lang kami ng problema kaya kami naghiwalay. Nagkaron lang po kami ng usapan ng naging asawa ko na tutulungan nya ako makapunta ng US so kailangan namin magpakasal. Sabi pa nya na if mag work e di itutuloy namin kung hindi di maghiwalay, atleast daw natulungan nya ako at matutulungan ko ang mga kapatid ko. kaso so umuwi ng pilipinas yung ex-boyfriend ko at sinabi nyang mahal nya pa ako, at ganun din naman ako sa kanya. During that time nasa US po yung asawa ko at ng malaman nya ay di nya inamin sa magulang nya tungkol sa nagpagusapan namin bago pa kami ikasal. Since then wala na po kaming communication, ngayon po ang may pamilya na sya sa US at napakasal doon. Ako din po na naman ay may anak na sa aking boyfriend na sinamahan.Nung kinasal nga po pala kami ay parehong wala sa pilipinas ang mga magulang nya, pero nag inilagay sa Marriage Contarct namin ay tatay nya nag nagbigay ng consent sa aming kasal, yun po ba ay pwedeng gawing grounds? At Eto po ang mga tanong ko;

1) Paano po mapapawalang bisa ang kasal ko? Ngbasabasa nadin kasi ako ng grounds for nullity kaso wala po ako makitang grounds. Sa legal separation din.

2) Kung sakaling magpapakasal ba ako sa pinas, pwede ba yun maging legal?

maraming salamat po attorney at sana ay matulungan nyo ako sa case ko.
