If one of the spouses secured a loan for his corporation and entered into a suretyship for the corporation's loans without the consent/knowledge of the spouse, can the creditor run after the conjugal property, more specificaly, the family domicile to settle the debt?

when did the other spouse learn of this loan, and what actions did he take to reject the agreement?

The other spouse learned of the suretyship (entered by the other spouse in 2009)about 8 months ago when things were not anymore going well with the company. Is there any remedy available for the other spouse? Thank you.

he can assert that the suretyship is not valid as to the conjugal properties because he made no consent. i recommend he writes a letter to make this known. his silence can be interpreted as ratification.

Mayroon po ba kayong sample ng ganoong letter. I dont have any idea what to say in the letter to the creditors. I will appreciate if you can give me pointers on what to say or if you can post a sample letter. maraming salamat po.
