Lupa na walang titulo at Deed of sale lang ang pinahahawakan. Paano po namin poprotektahan?

Magandang araw mo mga moderators,
Ang lupa namin ay 50 sqm lamang. Ito ay binili ng aking mga magulang sa aming kamag anak mahigit 25 years n po ang nakararan mula ngayon 2012, ang kalahati 25sqm ay binenta rin ng aking ama at ina sa aming kapitbahay. Natira sa amin ang 25sqm.

Ang lupang binili po ng aking mga magulang ay parte lamang po ng isa pang malaking lupa na may isang buong titulo. makalipas ang mga taon ay hindi nagawang maipatitulo ang parte ng lupang iyon hangang sa kamtayan n lamang ito ng aking ina nakaraan 2011 lang. At tanging deed of sale ang sa amin ay natira.

Kami ng aking mga kapatid ay handa na gawin ang nararapat para maisalin sa panagalan ng aming bunsong kapatid ang lupa(ito ay verbal na kahilingan lagi ng amin ina nung siyay nabubuhay pa) nais niyang ibigay ito sa bunso naming kapatid na pipi at bingi.

Dahil sa ang lupa ay deed of sale lang hindi po nmin sigurado ang naging sistema ng bayaran ng amilyar nito.

Ang mga tanong ko po ay ganito.

1. Paano namin mapoproteksyonan ang aming mana at maibigay ito sa bunso namin gayong wala kaming titulo?

2.Maari bang makamkam itong muli ng mga taong pinagbilhan ng aking mga magulang dahil sa sila ang nagbabayad ng amilyar?


3.Paano ko mapapatituluhan ang lupa namin? Nasa posisyon b ako bilang anak para ipag patuloy ang pagpapatitulo?


4. Magkano po ang serbisyo ng property lawyer? Meron po bang libre sa city hall?

if that property is already titled under a mother title, then you cannot have it titled on your own without having it partitioned and having the mother title surrendered and canceled.

Good morning Atty. i just want to ask for help. The grandmother of my wife is selling me half of their house but the land has no title. The original owners of the house is the grandfather and grandmother of my wife but her grandfather is already deceased. All of their children (including the father of my wife) are of legal ages. I want to ask the following:
1. Can she(grandmother of my wife) legally sell the half of their house to me?
2. Do we need consent of her children?
3. What legal forms do we need to sign before I pay her.

1) yes, because that is her sole property

unfortunately, the estate of the grandfather's half will also have to be settled and taxes paid for.

while legal, it doesn't sound logical. you're ok with only half the house? and note, if no title, the presumption is that the government owns the property.
