good day... ask ko lang po kung my rights ang anak ko na humingi ng sustento sa tatay nya, bale seaman po yung tatay... nagbibigay po sya ng suporta pero ndi po yun sapat para sa bata,, ang binibigay nya lang po ay parang pambili lang ng bata ng candy sa tindahan, its means po na kulang talaga.. hindi po nakaapelyido yung bata sa tatay nya... mag grade 1 n po yung bata, ano po gagawin ko para makahingi ako ng pangpaaral sa anak namin... slamat po

you have to first file a case to prove that he is the father

anong case po ang pwede kong ifile against him.. ang mga message po ba sa facebook ang pwedeng gamitin laban sa kanya??

to my mind, the proper recourse is to file a petition in court for acknowledgment and support. the best evidence is a dna exam. fb messages are not good proof

rhiya,
1. dapat i-prove mo muna sa korte na anak nga sya ng guy. tawag dun action to establish filiation sa RTC "to compel the father to recognize/acknowledge his child."
check mo yung birth certificate/baptismal certificate ng bata...signed ba ng tatay nya yung certificate?
do you have handwritten letters na galing sa kanyang tatay?meron ba doon nakasabi na tatay niya yung anak mo or in any way ni-rerecognize niya na anak nga niya yung anak mo?
"Art. 172. The filiation of legitimate children is established by any of the following:
(1) The record of birth appearing in the civil register or a final judgment; or
(2) An admission of legitimate filiation in a public document or a private handwritten instrument and signed by the parent concerned.
In the absence of the foregoing evidence, the legitimate filiation shall be
proved by:
(1) The open and continuous possession of the status of a legitimate child; or
(2) Any other means allowed by the Rules of Court and special laws."
kung wala then i suggest na humingi ka ng DNA testing order kasabay ng pagfile mo ng kaso sa korte.

DNA testing is too much expensive... how can i afford to do this test? do you have any idea how much it will cost?

pls help me po.. ang husband ko po seaman sya. tapos we had this fight na sobrang nanghihimasok ang mga magulang nya pati sa financial. ngayon po nakasakay na sya ulit and he is giving us only 15k. we had 2 kids na mag aaral na this june tapos po buntis pa ako. andito kami ngayon sa mother ko nakatira. sabi nya sya bahala sa school fees pero still kulang pa din ang 15k kasi kailangan ko pa po mag share kahit papano sa mom ko kasi college na ang 3 kong kapatid. tapos buntis pa po ako. ano po ba ang maganda ko gawin? thank you po.

Where can I download a template for affidavit of NO support?
My ex-husband has stopped sending his financial support to our children for one year now. The foundation who will provide college scholarship to my daughter requires an affidavit that formally states that my ex-husband has stopped his support. Can you send me links regarding this matter? Thanks.

hasta, it doesn't matter who will pay, but someone has to. if one of the the parties refuses, then the remedy is to file a motion in court to require it.
