Here's the story...

Meron akong kapitbahay na si "B" 40y/o, na madalas magsanla sa akin ng motorcycle at minsan pa sasakyan. Mayaman naman ang kanilang pamilya sa katunayan wala siyang trabaho pero tumatanggap sya ng monthly allowance hindi bababa sa 10,000 monthly, bukod pa dito sa magulang nya sya nakapisan kaya wala syang gastos sa mga billing at pagkain, pati asawa at anak nya ay may kanya-kanya ring allowance. Pero dahil sa bisyo kaya madali sya maubusan ng pera kaya sya nagsasanla. Lagi naman nya natutubos ang sinanla, mabilis na ang isang araw at matagal naman ang 2 buwan pero dahil kapitbahay ko lang ay wala naman naging problema sa tagal ng tubusan hanggang nitong huli kinailangan nya ng mas malaking pera kaya ang naunang sinanlang suzuki motor ay pinalitan na lang ng kotse. From 17,000 unang hiniram ay nagpadadag ito at umabot na sa 27,000 total. Hanggang isang araw nakita ni "J" ang nakatatandang kapatid ni "B" at administrator ng kanlang family business, ang sasakyan sa tapat ng bahay namin kaya inalam kung bakit andoon ang sasakyan nila. Napag-alaman din naman nya na naisanla iyo sa amin ng kapatid nya kaya pinatanong nya magkano naisanla upang matubos na daw. Nang maibigay namin ang kabuuang halaga sinabing magwiwithdraw lamang daw pero hanggang kinabukasan walang nangyaring tubusan hanggang sa umabot na ng 1 buwan na paghihintay dahil hindi naman din sila nagpa-abiso kailan matutubos iyon. Hanggang kahapon ng 1:00pm nagulat na lang kami na may biglang dumating na pulis from HPG na nagsiyasat tungkol sa sasakyan. May nag report daw sa kanila na si "J" na nawawala ang kanyang sasakyan at nakita nya ito sa lugar kung saan talaga ito nakaparada magmula ng maisanla, sa side street na tapat nga po ng bahay namin at 1 block away lang sa kanila na may-ari. Naipaliwanag naman namin sa HPG na iyon ay sinanla ni "B" at alam na iyon ni "J" bago pa man sya mag report sa HPG , paliwanag sa amin ng taga HPG, si "J" daw ang may SPA from the registered owner ng sasakyan kaya nais nya itong maibalik sa kanya at maaari daw kaming makasuhan ng carnapping dahil sa pagtanggap ng sanla lalo na wala pang kasulatan.
Ang tanong ko po, MAAARI PO B GAWIN IYON NI "J" KAHIT AWARE NAMAN PO SYA KUNG NASAAN ANG SASAKYAN INAAKO NYA?
According to hearsay gusto lang daw nya maturuan ng leksyon ang kapatid nya na si "B" na matigil na sa pagsasanla dahil abuso na raw. at marahil prara sindakin kami to easily get what they want.
MAARI PO BA NAMING IDEPENSA NA "B" CLAIM AT FIRST NA SA KANYA NA ANG SASAKYAN NA IYON KAYA NAMIN TINANGGAP, AT PAGPAPATUNAY NA MATAGAL NG NAGSASANLA SA AMIN SI "B" AY KANYANG ISANG SUZUKI MOTOR NA NASA AMIN PA?
MAAARI DIN BA NAMIN MAKASUHAN SI "B" SA CARNAPPING NA IBINIBINTANG NG KAPATID NYA SA AMIN DAHIL SI "B" ANG NAGSANLA SA AMIN?
ANO PO BA ANG MGA HAKBANG NA DAPAT NA NAMIN GAWIN NGAYON BAGO PA MAN KAMI MADEMANDA? Hindi naman po kami mayaman kaulad nila, hindi namin kaya mgabayd ng abogado, maaari po bang kaming humingi ng tulong sa PAO?

Thanks for the reply, when you say give it back should i return it myself or let them get it if they will get it, it's been 3 days since the incident happen but until now no one from them is getting it. I went to our barangay hall yesterday to file a complain so i could talk to the other parties involve face to face and whatever would be the agreement will be properly documented but the barangay official said it's out of their jurisdisction because the 2 brothers are not registered voters here, only their mom is the registered voter. Is that true?

Can i file a complain against "B" for alleged carnapping because he is the one who borrow money from me in exchange of the car as collateral? "B" also claim that the car was given to him so he can do whatever he pleases .

if they live in that bgy, then they can be summoned by the lupon, and that's a good move on your part. file a formal complaint.

the registered owner is the presumed owner.

you can consider an estafa case of other deceits.
