hingi lang po ako ng advice. yung parents ko po kase nangutang sa kapatid nya (tita ko na nasa ibang bansa), pero dahil wala silang maipautang, ipinasangla ung bahay nila sa pilipinas para maipagamit sa parents ko ung pera. kaso po hindi na nakayanan bayaran ng parents ko ung bahay worth 1 million ung utang. sinalba naman ng kapatid ng asawa ng tita ko ung bahay at ngayon dun kami pinagbabayad ng utang. dahil bumagsak ang business namin, tinulungan namin magkakapatid magbayad ang parents namin since 2008, kahit ang na ang nakapirma ay ang tatay ko. Namatay ang tatay ko nung 2010. 2011, di na talaga namin kinakaya magkakapatid ang pagbabayad kaya nagtext po kami na interest muna ang babayaran namin. sabi nila, by january 2012, bayaran daw namin ang principal, pero dumating po ang january hanggang ngayon na march 2012 na, hindi pa rin namin nababayaran magkakapatid ang principal. interest lang po ang tinuloy namin bayaran. pede po ba nila kami ihabla dahil sa nagreply kami sa text na magbabayad kami kahit tatay naman namin na patay na ang may utang at nakapirma sa kontrata?

is your mother still alive? they can still claim from her or from the estate of your father. but you don't need to pay for your father's debt except if you inherited anything, and only to the extent of the value of the inheritance

yes po, my mother is still alive. but she has dementia. and could not work anymore.
we didn't inherit anything. the house and lot we used to have was also taken from us by another bank coz my parents were also not able to pay for their loan. we are left with nothing.
really appreciate your reply attorney. I am just afraid that they will sue us because we replied to their text messages that we (my siblings) will try our best to pay our parent's debt..
