hi atty! i just want to ask something about concubinage... i've read that it is considered as such if a man had "sexual intercourse" with another woman. should it be an actual sex or online sex is also a ground for filing concubinage against my husband & his woman? i caught my husband doing that with another married woman. aside from having sex through chat, they also exchange vulgar pictures & they are planning to divorce their spouses, live together, & get married in another country. i hope you can give me an advice as to what actions to take against them. thank you po!

no, that would not be concubinage or adultery. it requires actual physical sex for adultery. concubinage require them living together.

if it is repeated, then it can be argued as repeated marital infidelity and it can be basis for psychological violence under ra 9262.

if you still want to save your marriage, legal action may not be the best recourse

maybe you're right... it's just that this thing is too painful & too difficult, i don't know what to do. but maybe i just need time to think...

let him know that you know. sometimes the threat of it is sufficient

note that if you cannot prove you were allowed to access his emails and chats, you cannot use that as evidence.
