1 LEGAL ADVICE ABOUT THEFT on Thu Apr 05, 2012 10:32 pm


Arresto Menor
I received a subpoena today for theft. Ready naman ako umamin sa faults ko. I am required to go to the Prosecutor's Office on Apr10(tues). I have a few questions lang:

1. should I bring a lawyer?
2. If I am to admit to the crime, should I do it then? sa pagpunta ko na sa prosecutor's office?
3. Is it mandatory to bring a counter-affidavit on Apr10? If aamin ako, yun ba dapat nakalagay sa counter-affidavit? Or ano ba ang dapat content nun?
4. Anong magiging status kapag inamin ko na? Will I be convicted agad?
5. Filed na ba ung case at this point? It says in the subpoena na for preliminary investigation kaya ako pinapatawag. Kasi I would try to settle with the complainant, para ibalik ko nalang ung nakuha ko na pera sakanya. Mawiwithdraw pa ba ung complaint at this point?

additional question po, ano po ba ang dapat dala ko pagpunta sa prosecutor's office? and andun din po ba ang complainant sa araw na 'yon? thank you po!

i highly recommend you at least consult a lawyer in preparing a a counter affidavit. having a permanent criminal record can be very difficult. or negotiate a settlement
