good day to all. mga sirs ask ko lang po kung pwede or may karapatan po ba ang wife ko na nasa states na kunin yung anak namin without my consent? taga-parañaque po ako at ganito naging sitwasyon.

may signed contract po kami sa dswd regarding sa welfare ng bata since babalik ulit sa states ang mommy nya't sa byenan ko daw dapat mapunta/magstay ang bata and sa kadahilanan na wala po akong stable job, di ko po maitaguyod nang maayos ang paglaki ng bata 'ayon' sa sinabi nila. currently, nasa byenan ko po yung anak namin and itinakas po nila bigla off to baguio..also without my permission after na maihatid si wife sa airport.(umuwi po dito sa pinas para maka-attend ng grade 6 graduation).

btw, 12 yrs old na po yung anak namin...lalaki po, magkasama kami noon pa man sa maliit na apartment na sinusustentuhan naman ni misis abroad...you can even imagine the real closeness at bonding namin mag-ama and legally married kami ni wife since 1999 pero naging bitter na po due to distance and miscommunication for the past 2 years not mentioning na laging pumapapel yung byenan ko na noon pa man ay gusto na kaming paghiwalayin plus wife looks like she's having an affair dun sa states(i got emailed pics of them together saved on my pc, salamat sa sister nya na sinisira din relationship namin).

my current situation is very depressing knowing na my wife and my byenan has so many plans just to get rid off my rights. makakayanan ko po kahit maghiwalay kami ni misis pero wag ang bata.

mga sirs kindly explain po kung ano mga karapatan ko, saan ako lalapit and alam ko po na para sa ikakabuti ng anak ko ang gagawin...pero alam ko din po na hindi nila pwede gawin sakin yun nang ganun-ganun lang at hindi namin napapag-usapan naming mag-asawa. sad to say mahirap lang po kami at may pera sila. mahirap po magtiis lalo na eversince dine-degrade po ako palagi ng family nya at iniiwasan ko po mag-isip at gumawa ng masama alang-alang sa anak ko. help po. Sad

without your consent, yes, the child can be allowed to travel with his mother outside of the country.

i don't see whether you are after custody of your child. your legal remedy would be to file a petition for habeas corpus and custody at the court of appeals so the order can be implemented anywhere in the philippines. at the same time ask for issuance a hold departure order

attorney gs2 ko malaman both kami ng asawa ko nasa ibang bansa pero separated na, at nasa magulang ko mga anak ko, it is possible na kunin ng biyenan ko mga anak ko kahit ayaw ko at pag dumating tatay nila pwd nya ba kunin mga anak ko at ipagkatiwala sa nanay nya kahit ayaw ko.

dad vs. your parents, dad will win. your parents vs. his parents, depends on who judge will see is more fit.

tell your parents not to give up custody without a court order.
