i was married to a girl who has been legally marreid before to another guy. Is our marriage invalid?

from the short facts you have provided, i am of the opinion that your marriage with her is invalid and she maybe held criminally liable for bigamy.
a married person , while the marriage subsist, cannot marry another as this is bigamous. the second marriage contracted is null and void in the eyes of the law and the married person who married again may be, as mentioned above, is liable for the felony of bigamy.

She also have a son from the same person whom she married before and her son is legally using the Guy's surname.
I have raised this question because I am planning to get married soon to my true love but when i got my "CENOMAR", it shows married as my status. If the second marriage is null and void, how am i going to have certificate to prove that I am a single person.

you need to file an absolute nullity of marriage in court to have your marriage with your current spouse declared null and void in order for you to remarry another.

^^it's a court process so it may take 1 to 3 years to finish..and yes you need to pay fees for 1)lawyers that you will retain and 2)court docket fees
