Arresto Menor
Dear Atty,

Ito ang malaki naming problema ngayon.. For the past years naghirap kami, nasangla ang lupa at balak na sana ibenta sa halagang P300,000.00. Dahil sa conjugal property at hindi pa nahati ang lupa ng magkakapatid hindi naibenta ang lupa, binayaran kami ng 250,000.00 at gumawa ng acknowledgement na narecieve namin ang pera,at pag may dead of sale na saka kami babayaran sa kulang. Sa acknowledgement nayon nakapirma ang lolo ko, papa ko at uncle ko.

May pera na kami para bayaran ang binigay na 250,000.00 ang problema ay ayaw tanggapin ng taong bibili sana ng lupa. Ang lupa namin ay napakinabangan nya. At kung kukunin daw namin ang lupa dapat daw 600,000.00 ang ibayad. Bibilhin daw namin sa kanila kc naibenta nadaw yun sa kanila pro wala namang dead of sale, acknowledgement lang na may narecieve kami sa halagang 250,000.00

Papano po ba ito Atty. ? Ayaw nila tanngapin ang pera na ibabayad sana namin sa kanila. Pano po namin makukuha ang lupa namin. Pwede po ba naming trabahuin ang lupa namin.May karapatan ba bah kami sa lupa namin dahil hindi naman talaga totally naibenta sa kanila? Pwde po ba namin ito mabawi?

the way you describe it, it sounds more like a sale than a mortgage. do you have any document which says it was just a loan?
