Hello!

I'm going to explain this in Filipino. Bata pa ako nasabi na sa akin na adopted ako pero hindi legal. Forty years old na ako ngayon. Mula noon mag aral ako dala ko na ang last name ng mga umampon sa akin. Nakita ko ang birth certificate ko at hindi nga pangalan ng mga umampon sa akin ang nakasulat doon na mga magulang ko. Ang nakasulat doon eh pangalan noong kapatid ng kinalakihan kong daddy. Noong High School ako, umuwi ako sa province at hinanap ko yun taong nakalagay na tatay ko sa birth certificate ko pero yun mga dinatnan ko doon dinala ako sa sementeryo para ipakita sa akin na bago pa ako pinaganak matagal ng patay yun taong nakalagay na tatay ko sa birth certificate ko.

Sa ngayon parehong patay na ang mga kinalakihan kong parents. May isa silang legal na anak na matanda sa akin. Ang tanong ko po ay ito: "KUNG HINDI AKO LEGAL NA INAMPON, MAY KARAPATAN PO BA AKO SA KAHIT ANONG NA IWAN NUN MGA KUMUPKOP SA AKIN?" Please po paki sagot lang.
Para po sa inyong kaalaman, yun kinalakihan ko pong daddy ay attorney din, siya po ang nag fill-up ng birth certificate ko.

As I was reading through other threads here...I realized that my situation is a "simulated birth". pinalabas nun foster dad ko na anak ako nun kapatid nya. But the thing is that person died many years ago after I was born (according to my date of birth in my birth cert.). High School pa lang ako I can sense there was something wrong with my identity according to my birth cert. PLEASE HELP!

I have no communication with their one and only child. Noon buhay pa po ang mommy namin at nakapag benta na sila ng properties sa probinsya meron na silang balak na ibili sana ako ng sarili kong bahay pero hindi po nag materialize yun balak nila na yun. Matagal na pong alam nun brother ko na hirap ako sa buhay. May properties pa o sya sa Manila. May isang building for rent at nabalitaan ko nga po nabenta last year yun bahay nila ni mommy sa Quezon City.

Honestly po I'm not going to ask for too much. Just enough for me and my kids to get by. Sa laki po ng pinagbentahan nun house sa QC, barya lang yun pwede nyang itulong sa akin at OK na sa akin yun.

Hindi ko po alam kung madadaan namin sa mabuting usapan ito. Ayoko naman po kasing lumabas na naghahabol po ako ganun sa abot po ng kaalaman ko eh WALA PO AKONG KARAPATAN. Atty., wala nga po ba akong karapatan? Kung meron man po at umabot ang usapin na ito kung saan, magsisisi po ako kung mabahagian man ako pero masira naman ng tuluyan ang pinagsamahan namin ng kuya ko ng tuluyan. He's the only family that I know of.

the right issue become relevant if the proper heirs don't want to share with you. if it's force comes to shove, you have no rights.

My advise, claim your share of the inheritance because as of the moment you are a legitimate child. You are not a culprit in the crime of simulation of birth. As far a you are concerned you are innocent and a legitimate child of your parent. Unless there is a petition for the cancellation of the entry of your birth, and an order granting said petition, there is the presumption of regularity to your legitimacy.
