July 5, 2011 po inappraoch ako ng HR legal (Ms Tet), at sinabe po na gusto na ako iterminate ng client namen. Nahirapan si Ms Tet kasi wala po sya mahanap n butas sakin dahil wala po ako violations, warnings, NTE etc. And in the first place regular employee po ako at promoted pa. I've worked with the company for 7 months po. Because of issues with the new manager na kakapasok pa lang last May 2011. Lahat ng galaw namen ay sinusumbong sa client sa Australia which made my client decide na ayaw n sya sakin. I was offered a package (1 month salary, 13th month, tax refund and commission) just to resign and leave the company quietly. This is my first time po and I really felt demoralized. Feeling ko po tinapakan nila pagkatao ko nag judge nlng sila bigla at hindi ako binigyan ng chance to explain. So what Ms Tet did was nag audit sila ng computers nmen so napull up po mga browsing history ko sa internet, which is sabe nya nasa contract namen na bawal yun, so grounds for termination daw yun. So i told Ms Tet i think its really unfair, sabe nya and yng isang manager ko tanggapin ko n daw kasi pera n daw yun. Sabe ko can i think about it, kasi daw they give me due process that will last 2-3 weeks, but si client ayaw n nya ako patagalin sa office. And that day po July 5 i was suppose to receive my commission which is given every 5th of the month. Inipit po ng client ko yun ayaw nya ibigay yng check. Nakiusap pa po ako sa kanya, ang liit liit ng tingin ko sa sarili ko non. Ang sabe nya.."if i give you your money, you'll leave quietly"? Sabe ko po yes which is ang hinahabol ko po is yung commission ko. Pero ang ginawa nya pumunta sa Accounting dept at pinahanda n yng perang inooffer sakin. Right then and there po gumawa si Ms Tet ng Clearance and Resignation Letter ko. So I was caught in the middle na po. Dalawa kasi sila nandun si Ms Tet at yng isa kong manager n mabait sakin. Umiiyak na lang po ako nun at pinapirma nila sakin yng clearance at resignation letter. Nauna po pumirma yng manager ko. So i feel intimidated na nung silang dalawa n nagconvince sakin pumirma. I was drained na po kasi maghapon na akong nakikipag usap kay Ms Tet, and another thing po, yng ibang ahente na naaudit yng computer nila, bingyan nila ng "notice to explain"..ako lang po tlaga ang gustong ipasipa.

So ayun after ko pumirma sabe ni Ms tet, balik ako tom for my checks at 9am.

Sobrang tuliro po tlaga ako. Kinabukasan i went to NLRC. I seeked advice po sa lawyer (i forgot her name po)..kinuwento ko po lahat, and advise sakin is to take the money theyre offering.

Honestly, kaya po ako nag message at nagshare senyo is gusto ko lng po humingi ng second opinion. Kasi up until now yng acceptance po kc ang hirap. Napakaganda po kc ng relationship ko with my colleague lalo na po yung australian client nmen. Gustong gusto nya po ako noon kaya nga po nya ako prinomote eh. Ang hirap tlgang tanggapin..andameng stress na pinagdaanan ko. I got my money nga pero po ang hirap po ng ganito i really felt demoralized.

Pasensya po sobrang haba.

up to now, malaking question po saken..kung "what if tinuloy ko ang laban?"what if nandun pa din ako sa company n yun?..marami poong questions unanswered, I just want to seek the best advice from you. What should i have done few months back.

I would appreciate if you could give me an insight about this. Coz i really want to make them pay for all the emotional stress na binigay nila sakin.

by filing a case as soon as possible, it will strengthen your case that the resignation was not voluntary.
