I'd like to seek advice to my problem.
I was married for 15 yrs but I and my 2 sons (16 and 19 now) left my husband 3 yrs ago. I didn't ask for any kind of support even if my husband is a policeman and has a salary and we also have a few rooms rented. Few months after we left him, he had a second woman and they lived in one of our rooms for rent as he knows that time that he is reserving our house for our sons. They separated and for about a year now, he is living with someone else. This woman seems to be interested in his properties and now my husband has agreed that they live in our house and the woman opened a small store business there.
I used to be quiet and just allowed my husband to spend all his money plus the rent of our rooms. However, now that he has another one, I'm worried that one day my sons might not have anything to go back home to and our properties (we got a few lots of which the titles are with my husband)might all be gone too. Thats why i have decided to ask advice from anybody here because i want to know my and my sons' rights to this and what we can assert from my husband. I believe it doesn't matter if i was the one who left him and we're not living together in regards to my rights as a wife and one of the owners of the properties they are now staying. Besides, worse comes to worse, i can sue my husband for living together with someone else. My only goal is to stop the growing desire of this woman on our properties, get what is due to my sons (support that they deserve) and prevent whatever worse that may happen.

Thank you.

geline, you can file a petition to be declared the administrator of the properties or a case of legal separation so that the properties will be awarded to you. meantime, gather your evidence. you will be asked to prove that he is living in with another woman. don't count on him to merely admit it.

aiko, you can send a demand letter to her to continue providing support and then file a case of economic abuse against her under ra 9262. what i don't get is why she would cut off support to you also. your stepdad can also file adultery against her if they are married.

Hi, thank you for your reply. I would like to inquire what kind of evidence I can produce. They are now living together in our house and he has even introduced his woman to my sons. Shall I take pictures of them and how can i make my evidences effective and reliable so as to appeal to the court.

Hi, I'm back and would like to ask few more advice.
My sons and I are now living in Manila and my husband is in Cebu. I'm thinking that I would like to have a negotiation with him about those matters and currently searching for someone who can help me mediate between the 2 of us. Would a barangay councilor be better than someone from where he works? He is a policeman and I am thinking that if I go to his boss or someone who he respects in the office, he would also be able to help me in terms of the getting of my sons' subsidy/support. Now, I am also anticipating that if I demand that they don't live in our house and I want to get share of the rent of the rooms we have rented, he would surely say , you need to come home and stay in the house if you want it back and he will probably also say, you need to stay and manage the rooms we have for rent, too.
My sons are already tired of moving from one house and place to another and we're already good here in Manila and probably better here. Compared to going home, they'd like to stay here as we don't have any worries about their father and his demands to probably want to see them many times if they are there in Cebu. And as for me, I'd prefer to stay in Manila too. Would it be alright if I say that I'd get back the house and just go there say in 2 months to check on it , just to show that I'm there and claiming it? What else can I do or say about managing the rooms for rent, if ever he says that?
Thanks for the advice.

another thing... i am planning to seek help in the office, he is a pnp member and im anticipating that we would confront each other infront of the people there and he will say, its my fault because i left him and now im claiming it back at a time that is almost too late cz before, he was keeping those properties to wait for us... and he would also probably say things like, i left them because i got anther one who is providing our needs thats why i didnt ask him for any support why only now? i wouldn't know how to respond to these in such a way that i would get the sympathy of the office.. please help..
