Hi hingi po sana ako ng advice para sa kapatid ko. Last Jan. 2011 po namatay po asawa nya at may isa silang anak. Ang nangyari po ay nakuha po ng mistress yung lahat ng benefits dahil dineclare po nya sa death certificate ng brother in law ko as single kahit alam naman po nya na may asawa at anak yun. Saka natagalan po na makapag process yung sister ko sa sss kasi po na depress po sya. Ang sabi po sa reason ng sss ay na release na daw po yung pera kasi po matagal daw po nag process yung sister ko at isa lang daw po nakalagay na beneficiary yung illegitimate child. May magagawa pa po ba kami para makuha yung para sa sister ko at sa pamangkin ko na legitimate child? Ano po ang dapat naming gawin? Sumulat na po kami sa sss pero sabi po sa amin doon daw po kami mag verify ng case nmin kung saan na release yung pera ang kaso po sobrang layo po samin. Saka po pwede po bang kasuhan yung mistress dahil sa pag falsify nya ng documents?

Maraming salamat po sa reply. Opo sumulat na po sya sa main nagsubmit din po sya ng marriage cert at birth cert nagreply nman po sa sulat kaso ang sabi lang po sa sulat doon daw po sya magverify sa branch kung saan na release yung pera. Yun na nga po yung reason nila matagal daw po nakapag process ng claim yung sis ko. Ang tanong ko lang po kung makakakuha pa po ba ng claim yung sis ko at ang anak nya sa ganito pong sitwasyon o talagang paunahan po talaga sa pag claim ng benefits? Yun lang po ang gusto naming masigurado kung may habol pa po sila at pwede po bang kasuhan yung mistress na nilagay po sa death cert ay live in partner samantalang alam naman po nya na may asawa yung tao. Ano po ang pwdeng ikaso sa kanya at saan po kami pwedeng lumapit?

My grandfather died almost 3 years from now. Death benefits for him were given to us since he lived with us after the death of his mistress but then the transfer of benefits to his wife is not approved due to some reasons: 1. He indicated his mistress and Illegitimate children as beneficiaries on his SSS E1 form; 2. We cannot provide any proof that his marriage to his considered wife per form E1 was performed after his marriage with his first wife. We only have His and My Grandmas's marriage certificate and Birth certificate of their first born child which clearly indicate when they got married. Technically, we are not allowed to get NSO records for the other family because we are not related to them. Now, as of writing, the doctor said my grandma will die in any moment. We would like to know if we can continue her claim after she died. She filed it prior his death but due to very slow processing in SSS, until now, there is no progress. Can we still fight for her right to claim what is right for her after her death? SSS representative told us that her claim will be denied (after quiet long fight) and benefits will be directed to his children. But his children is now at 40s and 30s. Is there anything else we can do? We beg for your help...
