Do memorandums issued by the company run as effective as employment contract?

If a memo was issued by the company, or just an account for this matter..since this is a BPO company, can they be regarded to as "contract" even though the contents of that Memo was not included in the Employment Contract that you have signed?

If you were to be terminated due to attendance issues that arised conflicting with the account, should you be terminated at all by the company even though the policy that "you have an issue with" is just with the account and not with the company?

SAMPLE:

Company Policy:
5 attendance issues = termination

Account Policy:
3 attendance issues = termination

Should the agent be terminated since he has violated the Account Policy, even though under Company Policy, he/she still has two chances (based on example above) of being in violation of Company Policy?

you can just go away and dont sign/join the company
or follow the policy..

If there are two or more conflicting policies, the one favorable to the employee should be the one applicable. The agent should not be terminated from the company, however considering that the agent violated the policy of his/her account, then such agent could be removed from the account or transferred to other accounts, but not termination.
