I AM NOT AN EXPERT... UR CLAIM IS (CONDITIONAL)OWNERSHIP AND THE THE THIRD PARTY IS ON POSSESSION, AM I RIGHT? uPON FULL PAYMENT IS THE TRANSFER OF OWNERSHIP..U MAY HAVE RIGHTS TO OWN BUT YOU CANNOT DIRECTLY PUT OFF THE 3RD PARTY CLAIM THEREFORE I SUGGEST GO AFTER THE NHA TO CLEAR THE PROPERTY BEFORE CONTINUANCE OF PAYMENT.OR RESCIND THE CONTRACT AND LOOK FOR ANOTHER PROPERTY TO BUY.YOU RE IN GUD FAITH HENCE, NHA SHOULD REIMBURSE UR PAYMENT, DEPENDING ON THE CONTRACT

you have better right, just hold onto the property and participate in any case that is filed. the nha is obligated to defend your possession

Hi Sir! Nasa process po kami ng pag-aquire ng foreclosed property ng Bahay Financial Services (BFS). Ang naghahandle ay ang Shelter Trade Property Management Services. Hiningan po nila ako ng 25k na facilitation fee. May tao daw na magfifinance sa property para ma-take out sa BFS bago ipasok sa Pagibig yung property. Hiningan din ako ng 20% down payment para sa financer para ifinance yung bahay.Mahigit 1 year na po hindi pa po kami nakakapagsara ng deal sa mga property na inalok nila dahil madaming nagiging problema. Yung unang bahay na inalok nila at na napili namin ay ibinenta na daw ng BFS kaya hindi na namin makukuha pagkatapos namin magdown ng partial. Yung pangalawang inalok nila ay nireredeem pa daw ng original borrower yung property. Ngayong pangatlo naman ay may hinihinging rights ang mayari ng property bukod pa sa naibigay namin na down para sa financer para itake out yung property sa BFS. Nakausap ko na yung nakatira sa property at hinihintay nalang din nila na makahanap ng magfifinance samin para makapagsara na kami. Kaso naiinip na po kami dahil sa tagal ng panahon na hinintay namin. Kung sakali po ba na magdecide kami na hindi na ituloy ang serbisyo nila may karapatan po ba kami na bawiin yung 25k nafacilitation fee na ibinayad namin sa kanila bukod sa down payment na ibinigay namin?
