imo, they can get your time deposit as payment for your unpaid amortizations, and suspend your credit card. they can also foreclose on your condo if you are not up to date.

hi atty, naintindihan ko ung pwede talaga ma-forclose ung condo unit kasi collateral talaga sya sa home loan.. pero ibig sabihin bukod sa condo unit hold and kunin pa nila time deposit ko? ung time deposit po ang concern ko.. kasi connected po un sa credit card. wala naman ako utang sa card and in good standing sya. ibig sabihin ba kahit mga bank accounts may karapatan sila limasin bukod pa sa condo unit.. eh an intindi ko ung value palang ng condo unit dapat ok na. wala din kasi ako makita sa contract na pwede sila collect ng iba pang property or bank accounts to collect - bukod sa pagfforclose ng collateral. tama ba pagkakaintindi ko? thank you po.

Good Day! I am due for a writ of execution due to a court decision in favor of the bank. Its amounting to 118,000 that includes all fees and interests. The principal amount is 38,000. I have consulted a Public attorney and told me to wait for the writ and let the sheriff come. He said that banks will not bother to pay for a sheriff if they see that nothing significant will be collected from me My questions are:
1. should a sheriff come,can I tell them that the appliances are not mine since I only live with my mother? This is what my lawyer told me.
2. will they take all the things inside my house including beds, refrigirator, etc?
3. my lawyer tpld me not to worry much since the case is expiring on June so they are doing everything to collect if there is anything to collect.
4. I am worried because i dont like my kids to feel the trauma of seing all our appliances taken by a sheriff.

may ilalapit po ako sa inyo, ganito po yun, nagka-utang po ang wife ko sa co-office mate nya dati dahil, co-maker nya po ito sa loan nya sa company at nagresign na po ang wife ko, sa office mate nya napasa ang pagbabayad,ikakaltas po ito every payroll, bali installment po ang pagkaltas sa officemate nya, ngayon po nagkasundo po na babayaran namin ito kada sweldo sa amount na ikakaltas sa kanya,nasa P 1,615.00 every payrol. Nagkapirmahan pa po sa brgy hall dahil pina brgy nya wife ko sa dahilan na baka di magbayad, ngayon po ang kaltasan sa company ng former officemate nya ay May 11 2013 natapat ngayon po iyon, pero ang sweldo po ng asawa ko ay sa may 15th pa po, nagagalit po sya dapat daw po ay gawan ng paraan, gayung hindi po namin kaya, kasi every 15th-30th lang po talaga magkakaron ng pera pambayad sa huhulugan sa kanya, pwede po ba kami kasuhan dahil sa hindi namin masabayan ang kaltas sa kanya ng company, gayung every 15 & 30th naman kami magbabayad at hindi naman po tatakbuhan dahil usapan na po na babayaran namin, yun nga lang hindi po talaga kaya sabayan kung kelan sya kakaltasan lalo na kung mas maaga sa 15th & 30th, pahingi po ng advice para po magkaron kami ng peace of mind sa problema na ito..


makakasuhan po ba at makukulong ang asawa ko atty?

Dear Atty,
Gusto ko rin pong magtanong tungkol sa lote na owned by my mother. Ang nangyari po kasi, she gave me verbal consent to sell the said lot so I did. Walang tinatawag na SPA or contract to sell - kung hindi ako nagkakamali sa term. Binigyan po ako ng payment na installment nung bumili. Ang problema po ay gustong makuha ulit ng mother ko, pwede pa rin po kaya yun kasi up to this time ay nakapangalan pa rin sa mother ko ang lupa.
And lastly, pwede po bang magkaron ng hold departure order ang may utang sa lending company?

Dear Atty.
Ask ko lang kung pwede ba akong mag-file ng suit for estafa against defaulted loan borrowers na ang evidence ko lang ay ang kanilang ATMs and a simple promissory note (a note stating that they received such amount from me)? and if so, where can I file the case, to my place of residence (which is Laguna) or to the borrower's place of work (Pasig, Makati, etc). Please advise po.

-hindi kami binigyan ng lending company ng copy ng contract. Dun sa office nila kmi pinapirma. It's my first time na manghiram sa lending and during that time hinahabol ko ang date of flight ko.
-pinapirma nila kami ng kapatid ko sa post dated check with date every 26 of the month. If I can still remember hanggang december of this year siya.
-pinag-open nila kami ng account sa bank, sa bank dinedeposito ng kapatid ko ang pera
-since lumipat ako ng employer I paid them end of the month dahil yun po ang sahuran ko.

Need po ng advise. Nanghiram ako ng perapsa lending company bago ako umalis ng pinas, ginamit kong pambyad sa placement, ticket and so on. Ang principal amount ay 150k with interest na 60k (210k in all). 6months ang term of payment ko which is 35k a month. Ang kapatid ko sa pinas ang co-maker ko. Istarted paying them last nov 2012. Ok ang pagbabayad ko for 3mos until las february I was not able to pay them because I resigned from my job dahil I will change employer. I informed the lending about it and assurd them that I will still pay my obligation. End of march I recieved my last salary from previous employer but only paid half on the lending(17k). That payment is for february. When I recievd my 1st salary from my current employer this end of april, pinacompute ko yung kulang and they said I need to pay them 36500. Ung 36500 na yun ay para sa february ung kulang kong kalahati at interest nila. My last payment with them is this may. I message the lending thru fb kung magkano pa ang kulang ko and they called my sister saying lapse ako ng 1 and a half month. Kelangan ko daw magbayaran ung 1 1/2 month this june. My sister asked them pano kung 35k lng ang mabigay ko, dahil yung lang din ang kaya kong ibayad, ang sabi nila kung hindi tutubo daw yun at aabot ng 70k nxt month(july). Ganon din sa mga susunod na buwan kung kulang ang ihuhulog ko. Nashocked ako sa computation nila. Kailangan ko pa ba sila bayaran ng ganon kalaki? Lumalabas na buong contract ko dito sa ibang bansa magbabayad lang ako sa kanila ng utang, which is so unfair. Na-compute ko ang lhat ng binayaran ko sa kanila ay 193500. Dapat ko pa po bang bayaran sila ng ganon kalaki? Ano po ang puwede kong gawin?

Meron po akong nais na ipa advise po sa inyo ukol po sa aking pagkakautang na halagang 10,000 po bago ako umalis ng Pilipinas nong june 2011. Bago po ako umalis humiram po ako sa isang kakilala sa amin ng halagang 10,000 piso. Ayon po sa aming usapan, ibibigay ko po na kolateral ang aking laptop at mgbabayad ako ng interest na 2,000 piso.Meron po kaming kasulatan pero ito ay hindi notarised, kumbaga sulat kamay lang po yon. Dahil po hindi ako nakapagtrabaho agad dito, hindi po ako nakapagbayad agad agad sa loob ng mahigit isang buwan kaya angsabi nong ngpautang, hulugan na lang namin buwan buwan ng isang libo. Nong nakapagbigay na kami ng 13,000 piso,nagpadagdag pa cia ng 3,000 piso sa loob ng 3 months, kaya 16,000 n lahat ang aking nabigay.Sa ngaun, tinatakot nila ang aking nanay na ipapadeport ako kung hindi ko mabayaran ang aking utang at ang sabi nila ung nabigay ko e interest lang yon sa aking nautang. At gusto niya bayaran ko pa din ng buo ung utang ko. Pwede po ba nya ako sampahan ng kaso? Ano po ang gagawin ko para idepensa ang sarili ko sa bagay na ito, samantalang 16,000 pesos na nabigay ko sa aking utang na 10,000pesos at may kolateral pa ako n laptop. Kelangan ko pong inyong advice sa bagay na ito..

Good day! ask po ako ng advice kung ano ang pwede naming gawin. Marami po akong nautungan samin at ngayon ay hindi ko na po mahandle ang situation. May work naman po ako pero hindi neto kaya pagsabay-sabayin and pang araw-araw namin at magabot sa kanila. Magulo na po kasi galit na silang lahat at pagsasabay-sabayin daw nila ang pagfile sa fiscal para makulong daw ako. Ano po ang maaring mangyari sakin at ano po ang pwede naming gawin? Halos di ko na po kasi masuportahan ang pangangailangan ng mga anak ko.

Just promise them you will pay them little by little according to your financial capacity.

The person is not criminally liable if he is willing to pay.

Just do not issue any instrument such as Postdated Checks.

good day!!! ask lang po ng advice... may loan po ako ng 35k from a private financing company 5 yrs ago (Oct2008), bale salary deduction po yun s employer ko on that time. hindi ko po natapos bayaran yung loan ko, half lang po ang nabayaran ko kasi nagtransfer na po ako ng trabaho (Dec2009). after 4 months nung due date nung loan ko (Feb2009) kinotak po nila ako to pay 27k, pero 14k lang po yung nabayaran ko kasi yun lang po ang meron ako. Remaining balance ko po is 13k. after 2yrs and 8 months kinontak po uli nila ako to pay may remaining balance plus interest, bale almost 45k na. Dapat ko lang po ba na bayaran yung 45k or may chance po na mapababa ko po yung dapat kong byaran?

magandang araw po ! gusto ko lang po huminge ng advace nagugulohan po kasi ako, ako po ay isang credit card messenger under ng agency almost 6 months po ako nag work dun.yung po kasing isang credit card na deniliver ko sa isang client nag kakoon po ng problema..na ideliver kunaman po ng tama at mis mo po sa bahay ng client ko deniliver kaya lang po ang nag recieve ay kamag anak daw sya ng card holder hiningan ko po sya ng ID postal Id po ang binigay nya at inilagay ko po dun sa delivery report yun Id number ng postal hindi po kasi pwde ipa recieve yun credit card kung walang valid ID dahil yun po ang requirements ng banko.samadaling salita po maayos naman po ang pag deliver ko.after one month pinatawag po ako sa frud dept. kc daw po yung deniliver kung c-card ginamit at inubos yung credit card limit at ng tinawagan nila yung client at ang sabi sa kanila wala daw po syang natangap na credit card at wala daw po syang ginagamit na credit card bakit daw po sya mag babayad ng bill.ipinakita po sakin ung record purcase slip kung saan namili yung tao at kung mag kanu ung naging bill..ang sabi po sakin ng attorney dun sa kapag daw po hindi ito binayaran ng card holder ichacharge daw po ito sa agency na pinag tratrabahuhan ko..ayon po dun sa agency 40.000 daw po ang charge na kukunin sa kanila ng banko at ito po daw ay babayaran ko sa kanila,sa ngaun po wla na ako dun sa agency almost 10 months na po akung hindi nag wowork dun ,,pero hangang ngaun po sinisingil nila ako dun. ang tanong ko po dapat po bang ako ang habulin nila sa credit card bill .. sana po mabigyan nyo po ako ng advice kasi po gulong gulo ang isipan ko.. maraming salamat po.

helo!patulong po sana ako regarding po sa situation ko.
member po ako ng direst selling.
meron po kasi akong existing na hindi pa nabayaran na direct sales sa up line ko.
nakikiusap po ako sa knya na babayaran ko.pero nagsend po agad xa ng final notice through law office na lahat daw po ng account ko eh back to its original(back to gross) and may penalty pa daw.so umabot ng more than 300k.ang scenario pa po eh trust receipt agreement po ung ginagamit namin pag nagbabayad ako taz pag kumukuha ako ng products sa aknila..hindi po official receipt.taz may nareceice n po ako final notice na estafa daw.
ang alam ko po eh hindi pa umabot ng 100k pero dahil daw sa penalty kaya nanging 300k plus.
andito po ako sa ibang bansa.maging basis kaya un para mapauwi ako?.
enexplain ko pa sa knya na naghahanap ako work para makabayad.

Hi po Atty. I just want to know if an interest rate of 78% per annum or 6.5%/month is "legal". Even the interest na naka-karga sa principal amount eh hindi po diminishing. I owe this Lending company a principal amount of 135,000 pesos. Meron pa silang processing fee na around 6% yata so ang nakuha ko na total proceeds ay umabot lamang ng 125,000. I was able to pay for the past 5 months. Pero with unforeseen financial crisis, medyo nag-lapse ako ng one and a half months. I issued 24 checks dahil ang payment terms ay every 15th. Nag loan ako last June 2013 and updated po ang account ko until December 2013. Today, dahil nag-bounce na mga checke ko, mag-file daw sila ng Estafa and Bouncing check law. Just this January, i again paid a partial payment of 10,000 pesos to show how sincere I am in paying my loan. In total I was able to pay 110,00 pesos already to the lending firm.

Now, for each lapse payment, meron silang late payment charge na 1,500 pesos. Apart from that, each day that passes na overdue yung account ko, they would charge an additional 1% per day. In total, yung arrears ko amounts to 83,000 for December and this January...pero yung latest statement of account ko says that I now owe 98,000 pesos in arrears including the penalty of 1,500 and yung 1%/day.

Are all these penalties legal and binding. I did sign a contract with them when I got the loan thinkin I can pay it easily. Pero dahil nga po sa financial crisis that I am going through, medyo nade-delay ang payments ko.

Can I still ask this lending form to waive all penalties? Do not get me wrong, I am very willing to pay and I am still have the capacity to pay the lending firm. Its jsut that ang bigat sobra nung interest rates and penalties.

They are now threatening to sue me in court with the Estafa and Bouncing Check Law. Its just that I find it really unfair since I communicate with them regularly and I do show them that hindi ako nagtatago at magbabayad talaga ako. Malaki na rin po ang naibayad ko sa kanila.

Any response is deeply appreciated. I only want your expert opinion before I seek a lawyer, and if you know a good lawyer regarding these types of cases, mas maganda po.

hingi lng po sana ako ng advice. may pnautang po ksi ako around 90k more or less excluding interest. magasawa po sila. isng pinay at isng kano. ang interest rate po nmin is 8% monthly ksi wala po silang bngay na collateral. sa una po ngbbyad pa sila pero kung mgbayad sila, halos prang babawiin dn ksi ngpapadagdag pa sila. at first akala nmin good payer pero ndi pla. nkiusap po sila mgpastop ng interest, gnrant ko nman po. after nun inistop na interest. bsta msauli lng sna ung principal na utang. puro sya bukas ng bukas hnggat years na makalipas ung bukas nya. wat should i do? and anu ang pwdeng ifile against sakanila. and meron po ba sila mffile against smen. please answer po. salamat
