Tanong ko lang po kung tama po ang ginagawa ng HR namin.

Eto po yung scenario:

Nilipat po kasi kami ng company last year, kasi po isasara daw po yung isa, nung nilipat po kami pinagsign po kami ng termination pero sinabi po samin na lahat naman po magpapatuloy don sa bagong company. Ngayon po, humingi ako ng COE tapos yung inissue po sakin July 2011 daw po ako nahired, pero ang totoo po non May 2009 pa ko nagwowork para sa kanila.

Ang sabi po sakin ng HR ganon daw po talaga, wala na daw po yung 2 yrs na naserve ko, back to 0 daw po lahat since nung transfer, kung ganon po, dba po dapat may nakuha muna kaming years of service pay don? kasi po parang lumalabas, mag iisang taon pa lang ako sa company sa dadating na July 2012 Sad

Ang sabi po ng HR namin dati, wala daw po kaming makukuhang severance pay from the other company kasi daw po nung nilipat kami sa bago, REGULAR employee na po kami agad. Although yung contract po na pinapirmahan samin effective July 2011 ang nakasulat, so meaning po non wala na po yung May 2009 namin to June 2011?

Sabi po nga po ng Admin Head namin, ihanap daw po namin sya ng batas na nagsasabing dapat may makuha kaming severance pay sa dating company.

Eto pong bagong company, yung dating finance namin sa dating company sila pa din po ang finance namin ngayon, yung boss namin na korean sya pa din ang nandito, same people pa din po, iba na nga lang yung company name.

Ano po ba ang pwede namin gawin? Kasi po pag nagtatanong kami, ganyan po lagi ang sinasabi samin.

File a labor case- Go to NLRC and file a case for illegal dismissal and payment of separation pay. Go to the NLRC nearest to your old company. Accomplish a complaint form. Then attend all conferences. It's free.

The company that you are working for is relying on the separate personality of your first corp in order to escape liability.

Yun nga po eh, lumipat lang ng building, pagtawid lang. Pero po kasi connected pa ko sa bagong company, baka po masamain nila yun pag claim ko, ano po bang dapat kong gawin? pag nakuha ko na, hindi na din po healthy na magstay kasi for sure mag iiba na din po yung treatment sayo ng management.
