Ako po ay 24 atong gulang ng ako po ay nakabuntis, sa pagmamahal ko po at sa kagustuhan kong mabigyan ng pangalan ang magiging anak ko ay nagpagawa po ako ng Marriage Contract at ito po ay naregistro sa taong 2005.
Nagsama kaming bilang magasawa hanggang sa ako'y nagpasyang magpunta sa Saudi Arabia nuong 2007 upang magtrabaho. Dalawang taon po ang aking kontrata. Ako po ay nakaramdam ng pagbabago noong 2008, bagamat alam ko na me kakaibang nangyayari tuloy pa din po ang padala ko ng pera, hanggang dumating ang hulyo 2009 siya nga po ay umamin sa akin na siya ay nagdadalang tao ng tatlong buwan. Nakauwi po ao ng Nobyembre ng 2009. Gusto ko pong magsampa ng kaso ngunit nangibabaw po sakin ang awa.
Ako naman po ay may nakilala, bagamat alam nya na kasal ako ay tinanggap nya pa rin ako at minahal ng buo. Di lumaon ay nagpasya kaming magpakasal din sa Munisipyo at biniyayaan ng isang anak.Kami po ay masaya at tahimik na namumuhay ng nalaman ng aking unang asawa na ako nga po ay nagpakasal muli, sya po ay nangakong manggugulo sa buhay ko ngaun lalo na po sa aking asawang na isang guro.

Sana po ay matulungan nyo ako sa aking katanugan.

1. Me pagasa po ba na madismiss ang kasong Bigamy sa akin?
2. Me pagasa po ba akong manalo kung sakaling hindi madismiss ang kasong bigamy sa akin?

to convict you, all that is needed is to produce the two marriage contracts from nso and a witness to prove that you are the same husband in each one

Ung first wedding ko po walang nangyaring ceremony, or kahit po picture man lang, besides po ung babae ang nanloko sakin habang nasa saudi pa po ako. is it possible po ba na panigan ako ng court na walang bisa ung first marriage ko? ano po ba ang mainam kong gawin ? namba-blackmail po kasi ung una kong asawa.

Di pu pala ganun kadali mag convict ng bigamy? panu pu pala kung wala pira ang asawa tapos iniwan ng asawa nagtungo sa abroad at nakasal sa iba. di po mahabol yun dahil wala naman ricord sa NSO ang isang kasal nya.

Ano po pwede ikaso sa asawang sa pamilya ay nagpapabaya sa financial support pero sa ibang babae napakagalante. Marami po akong ebidensiya sa email nya na nabubuksan ko dati na hinde nya alam. Malaki po ang sinasahod nya sa australia. Pero nagbubuhay binata po cia dun. Mayroon din po ako ebidensiya na gumalaw cia ibang babae dun mismo sa email nya sinabi nya dun sa babae. Sa batas po ba ilang per cent dapat sa pamilya kapag ang asawa ay nasa abroad, meron po ba nun?

Bayani30 - Ang genereal rule ay dapat ma-declare na null and void ang kasal bago mapayagang makasal ang parties muli. Kung hindi, pwedeng makasuhan ng bigamy ang party na nagpakasal sa pangalawang beses. Pero may mga bagong kaso ngayon na sinasabing kung walang marriage ceremony na naganap ay hindi na kailangan ang declaration of nullity of marriage dahil walang bisa na talaga ang kanilang kasal.

AWV - ang secondmarriage na naganap, para makasuhan ng bigamy ang party, ay dapat nagawa dito sa Pilipinas. Kung hindi, hindi naganap ang Bigamy dito sa Pilipinas at walang jurisdiction ang Philippine courts para dinggin ang kaso.

Mrs Heartache - Bilang legal na asawa, pwede kang humingi ng support sa iyong asawa. Ang support na ibibigay nya any base at depende sa kung magkano ang kinikita nya.

Hi everyone especially to all lawyers....

Ask ko lng po if ilang years para mapawalang bisa ang kasal ng isang tao especially kung nasa Philippines ka.Other people said that kapg 7 years wala kayong any communication or both parties,pwede na uling ikasal ang isang tao!?Is that true?Without legal actions?Confused kasi ako sa ibang tao.....Hope that you can give some knowledge about it..

Before the passage of the Family Code, if the spouse is absent for 7 years, he/she could be presumed dead and the remaining spouse could remarry. However with the Family Code, you could presume a spouse to be dead in 2 or 4 years depending on the circumstances and the nature of his/her work. But for the purposes of contracting marriage, you would have to petition the court to declare him/her dead by presumption of law.

Do you think that your husband is dead? If so, there is no need for annulment. Just a court declaration of presumptive death. However, if he surfaced back, the 2nd marriage will be voided.

Ay salamat naman pu kung ganun! kasi ang mga swangit na kamag anak ng insan ko grabi kung maka black mail sa insan ko. tapus yung ina kaya pala pilit gusto ipakasal sa amirikano yung anak nya sa Pinas para lang pala miron silang minahan ng pira habang buhay. sabi kaya ng piskalya sa lugar nila di na raw nila kailangan magpakasal ulit kasi kasal na sya sa US. tapus yun pala ang ganid na planu ng ina ang gawin silang palabigasan ng asawa nyang kanu. Hay buhay nga naman sa Pinas kabi kabila ang mga manluluku ultimo kadugo mu lulukuhin ka rin. sabi ku tuloy sumbong nya kay Tulfo para mabigyan ng lesson. Very Happy

Let say atty yun hawak lang po ng asawa ay NSO-copy ng 1st marriage at NSO-copy 2nd marriage at walang witness ma co-convict ba sa bigamy? o kailangan talaga ng witness?

May naka pagsabi din kasi sa akin na enough na yun nso-copy ng 1st at 2nd marriage..pls confirm po

Eh papaanu pu yung Tita ku pu napikot sa kanyang unang kasal sa Pinoy at walang ceremony kundi sa kakilala lang nung lalaki kasi nga pu pikot. tapos dahil pikut tumakas pu ang asawang babae lomayu at pumunta sa abroad at nakakilala ng Pinoy pero US citizen na sya walang Pilipinas passport nakasal sila at wala pung record sa NSO yung pangalawang kasal sa Pilipino dahil US citizen na pu hindi na Pinoy citizen meron pu bang kasu yun? Shocked

it may be considered bigamy committed under the laws of the United States. It depends if their law considers a void first marriage as a defense. in the philipiines, it is not.

Do you know where your husband resides in Australia? You may have several actions against him but it is impotant that yopu know his address so that proper service of notice may be done by the court.

This is more likely to be possible in the US, because US is link to Philippines but not in Australia, as Australia is like UK they don't care what are your mess in your country as long as you are not wanted or a terrorist, they don't easily believe any documents presented to them as there are lots of fake documents submitted to them in the history.

The Australian boarder and UK boarder is mainly concern if you get involve with sham marriage which typically occurs when you marry a citizen as a means of circumventing immigration rules and attempting to gain long-term residency and the right to work and claim benefits.
Just wait when he return to your country if he ever do!

This post-script is written in addendum to very good arguments raised by my classmate in law school, Atty. Jeffrey Ravelo, who presently teaches public international law.

Atty. Ravelo asked whether or not jurisdiction over the second marriage can be obtained by Philippines courts, considering that it was celebrated abroad. He also raised Articles 15 and 17 of the Civil Code which provide:

Art. 15. Laws relating to family rights and duties, or to the status, condition and legal capacity of persons are binding upon citizens of the Philippines, even though living abroad.

Art. 17. The forms and solemnities of contracts, wills, and other public instruments shall be governed by the laws of the country in which they are executed.

When the acts referred to are executed before the diplomatic or consular officials of the Republic of the Philippines in a foreign country, the solemnities established by Philippine laws shall be observed in their execution.

Prohibitive laws concerning persons, their acts or property, and those which have, for their object, public order, public policy and good customs shall not be rendered ineffective by laws or judgments promulgated, or by determinations or conventions agreed upon in a foreign country.

Basically, what Atty. Ravelo is saying is that theoretically, because the second marriage was celebrated abroad, therefore, the criminal act was outside of Philippine territory, which is one of the components for the courts power to put the case into trial. Hence, there was no criminal act of bigamy committed because the second marriage was done outside the scope of Philippine criminal law to enforce. This is supported by Article 2 of the Revised Penal Code which provides:

Except as provided in the treaties and laws of preferential application, the provisions of this Code shall be enforced not only within the Philippine Archipelago, including its atmosphere, its interior waters and maritime zone, but also outside of its jurisdiction, against those who:

1. Should commit an offense while on a Philippine ship or airship

2. Should forge or counterfeit any coin or currency note of the Philippine Islands or obligations and securities issued by the Government of the Philippine Islands;chan robles virtual law library

3. Should be liable for acts connected with the introduction into these islands of the obligations and securities mentioned in the presiding number;

4. While being public officers or employees, should commit an offense in the exercise of their functions; or

5. Should commit any of the crimes against national security and the law of nations, defined in Title One of Book Two of this Code.

Note that the second marriage does not fall within any of the situations allowing for extra-territorial jurisdiction of Philippine criminal laws.

Hence no crime of Bigamy has been committed by Sonny.

There are sometimes when yes, I reach the limits of my magnificence, and I have to defer to the wisdom and sound reasoning of a brilliant legal mind. So to my companyero and (Im proud to add), classmate in law school, Atty. Ravelo, thank you very much for your input on this matter.

hango sa aking mga nalikom na kaalaman mula sa forum na ito na may kinalaman sa kaso na BIGAMY, kung ang kasal ay naka rehistro sa NSO sa makatuwid ito ay kinikilala ng bansang pilipinas o isang legal na kasal na walang kinalaman kung saan man ito ginanap.

Sa mga tunay na abogado, kumuha o kumukuha ng abogasya - tama ba ang aking pang-unawa sa usaping ito?

Kung saan naganap ang ikalawang kasal duon Lang ito mafile ang case. Kahit kasal sila sa consulate ng Philip Embassy usually Di naman nila I forward ang marriage certificate sa Census lalo na sa bansa ng mga Arabo maraming mga kababayan natin ang kasal sa Pinas at sa Consulate upang maiwasang mapahamak sa bansa ng mga Arabo. Kasi Kung Hindi parehong ginanap sa Pinas mahihirapan kayong kumuha ng tetistigo at katibayan at maaaring pala basin o itanggi ng mga Taga Embahado dahil common sa mga kababayan natin ang nagpapa kasal sa Embahado. Pero nakakalusot sila.
