Nais ko po itanong kung ano po ba ang mas advantage kasi bumili ako ng property sa tiyahin ko ang problema di namin alam ang gain taxes kung magkano kasi matagal na di binabayaran at matagal na din kaming nakatira sa lupang iyon since 1992 pa. Ang system ng pagbabayad sa lupa ay hulugan po monthly basis at ang land area is 100 sq meter. Ngayon sabi ng tiyahin ko na e apply daw niya ng Deed of Donation sa DENR di ko alam kung ano ang dahilan since there was money involved di naman ako papayag baka in future magkaroon ng problema. Sa kasalukuyan ang lupa ay di ko pa tapos sa pagbabayad pero gusto ko sana na magkakaroon ng documents bilang katunayan na mayron akong karapatan currently ang temporary receipt lang ang hawak ng aking mga magulang kasi dito ako sa ibang bansa nagtatrabaho. Tama po ba na deed of donation ang e apply ng tiyahin ko at ano po ba ang benepisyo kung ganun ang gagawin nya instead of mag initiate sya ng deed of sale. Sana po matulungan ninyo ako kasi wala akong idea in terms of land acquisition. At isa pa nag initiate ako ng isang written agreement hinggil sa lupa naka estate po doon na ang tiyahin ko ang magbabayad ng gain tax but she refused. Sino po ba talaga ang magbabayad non ang buyer o seller. Salamat at God bless

1. capital gains tax is different from real estate tax(o amilyar). the seller is supposed to pay the capital gains tax. capital gains tax is 6% of the contract price or assessed value of the property, whichever is higher. this is one time payment. now, what you may probably be referring to as "gain taxes" is the real estate tax(o yun amilyar). this one is annual(or quarterly depending on your preference). this one is not fixed because if the declared owner is not paying religiously, that declared owner will also be assessed or required to pay penalties and surcharges depending on how many years that owner has not paid.

2. deed of donation with denr is problematic. what you can do is make him sign a contract to sell. so when you have fully paid the property you bought then you can compel the seller(or your aunt) to sign a deed of absolute sale.

again, capital gains tax is supposed to be paid by the seller. real estate tax o amilyar is supposed to be paid by the declared owner. lastly, what you can do is enter into a contract to sell.

Nais ko rin pong mag tanong,tungkol po ito sa share partition ng aking mama,ito po ay pinamana ng aking lolo,ngayon po ay ginawan ng title ng aking lolo, lima po silang mag kakapatid lahat po sila ay may mga share narin,ang problema po ay istead na ipangalan sa kanilang mag kakapatid ito po ay naka pangalan pa po sa lolo ko,ngayon po ay meron po kaming ibibenta na 500 sqrmtr na portion sa share sa aking mama,my title na po?
Ngayon yong buyer namin pina kuha kami ng certified tru copy tapos pina survey namin pagkatapos humingi din sila ng name ng lahat ng magkakapatid,kailagan pa ba pomerma pa ang mga kapatid kahit may roon narin silang share na lupa.
ang lola ko po ay patay na, lolo kung nalang tapos na stroke siya ngayon hindi halos makagalaw
