Hi,
I need help po....
Heres my situation, Weve got married in Jan 2006, I was 18 and he was 21 at that time. We did not secure any marriage license, but when Ive got my nso marriage certificate it has a marriage license number, and it was registered in San Juan, but none of us lives in San Juan. Im living in cavite and he lives abroad (San Francisco) and he left me for another woman in 2007. Ive checked the license of solemnizing officer and he in not registered or authorized solemnizing officer at the time of our ceremony.
Now, I want our marriage to be nulled and void. whats the best thing to do?

Hi joanofarc.

You may file for a petition for declaration of nullity of marriage. The ground is lack or absence of formal requisites of marriage, i.e. marriage license and authority of solemnizing officer.

One more question po, can I still file for declaration of nullity of marriage kahit po 6 years na kameng kasal? Saan po ako magfile? Do I need to get a private lawyer?

Yes, a petition for declaration of nullity of marriage shall not prescribe. The action shall be filed before the RTC of the city or province where you or your husband has been residing for at least six months. It is best for you to contact a lawyer so that your situation may be fully appraised.
