Good day attorny. Single mom po ako, nitong mga nakaraang araw, hinahanapan ako ng butas ng manager ko. Minsan sa isang pag uusap po namin, na irecord ko po ang usapan namin, ng di niya alam, at sa usapan na yun, madami po siyang sinabi na sa tingin ko labag sa karapatan ko bilang isang empleyado. Tanung ko lang po , eto po ba if magdedemanda ako, tatangapin po ba ito ng korte ? Marami pong salamat.

Pagkaalis ko sa office attorny, eto ang nangyari.

1. Nagpamiting sila sa ilang kapwa ko managers, nagpapapirma ng sworn statements na may sinabi daw ako na masama sa company.
2. Ng sagutin ko ang letter nila, iba naman ang pinasasagot nila, pag di sila makasagot sa tanong ko, ibang kaso naman ang ipapatong nila. paikot ikot po.
3.Dun sa taped conversation, pinipilit nila ako pumirma ng biglaang evaluation 6 months period. Ginawa ko yun para magkuwento man sila sa ibang tao, di nila ma twist ang mga sinasabi nila. ( ginawa na po nila ang magkuwento sa iba, na ibang iba sa sinsabi sa akin na naka tape)
4. Mag voluntary resign na lang daw ako.
5. Sinisiraan nila ang may ari.

don't make it easy on them. they are probably asking for a resignation because the case against you may not be solid.

Done already. May 2 dates na ako a sked from the office of the arbiter. Ang siste ng office atty, kapag di nila msagot ang written letter ko, gagawa ng panibagong ikakaso sa akin, di ba dapat nuong una pa, kung me ikakaso sila ? After the filing nung July 3, do i have to answer their letter kanina ?

Padadalhan daw sila sabi sa akin ng NLRC. Hiningi nila (NLRC)3 copies. Eto po, just idadagdag ko, binawasan nila ang salary ko, nakalagay sa payslip, June 16-30 payroll, nag email po na humuhingi ng explanation,data, 5 days na ang nakakalipas walang response.

Atty good am. Eto pa, unang response letter ko, nilagay nila ako sa preventive suspension, sa letter ko, tinanong ko ano specific na ikakaso nila? Threat ba ako sa upisina ? Pinadala ko iyon sa sulat ko. Di nila masagot, at wala sa employee handbook namin ano proseso ng suspension, mag alituntunin na dapat gawin, kaukulang parusa. Tapos just recently di pa natatapos ang preventive suspension ko, binigyan nila ako ng termination letter. Tama po ba ito ?

there should be already scheduled dates for mediation. you can discuss a settlement there, and then be prepared to file a position paper.

Attorney ano po ang ibig sabihin nito ?
a whistleblower need not also be a complainant or a witness. A whistleblower, for whatever reason, can choose to be anonymous. In which case, he or she cannot be compelled to be a witness, much more be a complainant.

Kasi the one who presented the chat transcript is also the complainant. Please enligthen me on this matter. Salamat po ulit.

as expected atty, nag file ng contra reklamo sa akin ang kumpanya, maliscious mischief, may mga binura daw ako sa laptop ko, eh papaano mangayayri yun, ng isoli k sa HR ang mga gamit sa akin nun July10, ineksamen pa yung laptop sakaby bitaw ng salita na nakita na daw niya iyon, ( nakatago lang siya sa drawer ko, at ginalaw na walang paaalam), baka siya may binura. Ng iaabot sa akin ang checklist, nakalagay dun sa portion ng laptop, ( OK) at checked by: pirmado. namin pareho.. Nakaka apekto na sila atty, lalo na nung dumating by registered mail ang subpoena na may kaso daw akong maliscious mischief.

Ano po gagawin ok. Help po.

Di dumating ang abogado ng kabilang panig. Atty, ask ko lang po, ang pinirmahan na salaysayin ng isang co employee puwedeng gamitin sa korte laban sa isang co employee din? May mga kasamahan ako na gagawa ng kanilang salaysay. Wala silang oras para tumakas sa office.
