hi atty,nag file po ng annulment ang asawa ko,.lahat ng nakasaad dito ay pawang kasinungalingan lahat...sumaSAma po ang loob ko dahil sa kabila ng lahat ng pagtitiis,paghihirap at pag unawa ko,.eto pa po ang sinukli niya..nag file po siya nito gawa ng meron na po siya anak sa kabit niya..ang tanong ko po atty,.ano po ang aking gagawin??gusto ko naman din po mapawalang bisa ang aming kasal pero di ko po kayang tanggapin ang lahat ng nakasaad sa annnulment na nakasulatdito..totoo po ba na kapag nag testify ako,maaring di pa mapawalang bisa ang kasal namin??possible po ba na kung sakaling mag testify ako para pasinungalingan lang po ang mga lahat ng bintang sa akin eh mapapa walang bisa pa rin po ba ang kasal namin,?gaano po katagal ang proseso na ito?at kung di ako magsasalita,mapapabilis po ba proseso ng annulment..salamat po

If you are going to contest it, the process will definitely be lengthened. The court will give you the chance to present your evidence and witnesses to support your opposition. If you argue that the contents and grounds of the petition is untrue and the court believes you, the petition will be dismissed.

Hi atty. similar po ang case ng ate ko sa case ni anika. gusto nya na rin pong ma-annul dahil may anak na sa iba at un na ang kinakasama nya pero sa annulment ay psychologically ill and incurable daw ang ate ko. nurse po ang ate ko and practicing. since un ang grounds na ginamit laban sa kanya pwede po bang humingi ang ate ko ng alimony? at pwede rin po ba silang humingi ng basic needs tulad ng bahay? sa ngayon po kasi ay nakatira ang nag-iisa nilang anak sa magulang nong husband nya subalit ang ate ko pa rin po ang nagsusustento.ang ate ko po ay umuwi na sa amin. pls. advice po. thank you.

the child will always be entitled to support. the wife will be entitled as long as the annulment is not final. as for a house, that will be based on an agreement.

pano po kung hindi nagbibigay ng sustento ung asawa nya kahit di pa sila annuled? pwede po bang hingin ng ate ko ang mga dapat na sustento nya non sa kanila?

pahabol po pala.... o pwede po ba magdemand ang ate ko ng agreement para sa sustento and sa mga pagkukulang nya nong di pa annuled ang kasal nila?

she can ask for any of those. ideally there should be a written agreement. if the husband refuses, her remedy can be to seek support from the court where the annulment case is pending.
