Dear Atty.,

Magandang araw po sa nyo ako po ay isang hamak na kahera lamang sa isang computer station dito sa amin. Inakusahan po ako at 3 ko pa po na kasama ng discounting without authorities. January 2011 daw meron daw discounting of zero sa sales. At that time they hired 4 additional personnel at hindi na po ako ng kakaha ng aassist na lng ako. Binigyan ho kmi ng memo regarding dito, hindi po ako ng reply sa memo na yan at kahapon lng po July 4 2012 meron naman po akong memo RE: Notice of Investigation. Nakasaad dito kung bakit hindi po ako ng reply at sa July 10 e meet nya apo ako at mgpatuloy ang meeting with or without my absence together with his Atty. Ngayong July 10 po hindi ho ako mg aattend ng meeting nya at di na rin po ako mg reply sa 2 memo na related dun sa discounting wla naman po akong kinalaman dun kaya di ko na po inisip na magreply. Pinag-iinitan na po kmi na mga regular employees nya 9 na po umalis dahil di nakayanan ang mga paratang nang kun ano-anu. Maraming salamat po sa nyo Attorney malaking tulong po sa akin sa amin ang sagot nyo po :-). Attorney mali ho ba ang ginawa ko sa di pgreply ng memo? Good day!!

If you do that you are waiving your right to present your defense. And you will be bound by the result of their investigation. They can even validly terminate you.

In any case, it is your right to waive your right.

Magandang araw po Attorney, binigay po sa akin ang Termination Letter today July 25, pero naka date po ito July 23 2012. ito po ang laman.

" After carefully considering your case and the your corresponding explanation during the investigation/hearing of your case as well as the written explanantion that you have given to the management regarding the acts you were asked to explain as per our letter addressed to you, management is of the option that you have committed major violations to the existing company rules and regulations and under the labor code Article 282 for fraud and willful breach of trust. These fraudulent and dishonest acts of illegal discounting of ticket sales and the unauthorized price increase of grocery items have been consecutively happening which cause losses to the company. By reason thereof, management is left with no choice but to terminate your employment effective July 30, 2012.

You are hereby advised to immediately turnover all your duties and responsibilities to the undersigned. Thank you for your service to the company and good luck in your future undertakings."

Yun' po Attorney, in summary po before magtapos ang 2008 yata all branches (3 branches) may additional charge na 1 piso yung drinks (sting, tropicana, mountain dew) at foods pero hindi hindi naman lahat. At that time po P165/day kmi ngdagdag ng P15. po noong 2009 before mag opening class or August 2009. Yung mga dagdag binabayad po namin sa mga damages( lost and cracked bottles, foods na kulang ang pack at yung mga kinain ng daga)November 21 2010 nalaman ng boss namin. Nagalit ng husto, ng stop kami November 22, 2010 balik sa regular price. Binigyan kami ng memo (3) tatlo kami Ricky, Mae at ako. Ang tanong namin kung bakit kaming tatlo lng samantalang lahat kami ang gumawa.Ang sabi kasi daw the mentioned named ang OIC for each branch kaya liable kaming tatlo. Hindi kami pumirma sa memo, marami po ang naicharge na kasalanan namin. This May 21, 2012 binigyan po kami(4), ako ng memo ragarding po doon pero ang nakasaad po ay 6 months ago,which is 2010 pa po. Nag reply naman po kami. After that, this July 02, 2012 memo ulit regarding sa discounting tickets na ninakaw daw....everyday daw po. Hindi po ako ng reply sa memo, hanggang ngpadala po ulit ng letter of Notice for Investigation on July 10, 2012. Nag attend ako at si Mae. Pinakita po sa akin/amin ang nakaprint out na sales. Nakita ko po na halos lahat yata naka zero discount. Feb. 02 2011 po ako at si Mae ang on duty, hindi ko po matandaan kung ano at kung paano po na ganun. Wala po akong nasagot sa tanong kung bakit zero discount ang sales except po sa sinabi ko nga minsan kasi ma click mo yung enter at hindi na madiscount, at minsan naman ma wrong dsicount po. Nakasulat naman po doon sa sales merong (+ at amount). Before kami ngbabayad if ma wrong discount, later we note it doon sa sales. But not exactly to do it, nandoon naman po yun sa sales makita kung ano. Kaso lng po eh, meron akong wala na discount yung 11 hours dapat e discount mo na maging 100 kaya po hindi naisulat. Kaya ito po Termination letter na.
Attorney pasensya na po, naging mahaba po ang sulat ko. Hindi po ako nag sign sa recieved. Lastly po, regarding dito ano po ba ang laban namin if ever na dalhin ko ito sa Labor? Possible kaya na mabigyan kami/ako nang separation pay? Or di kaya back pay? Attorney, maraming salamat po sa inyo. Malaki po ang maitulong nyong advice sa akin. More power sa inyo!
