all laws passed by congress have to be constitutional, meaning it cannot go against the constitution

Good day, i was married last December 2003 in Manila City hall, since the day after we got married, he went back to US, and since the day he left, he never called me, and i don't receive any news about him, i tried to call him but he change his number, i even tried to call his number in his work but they say he was already resigned, its been almost 9 years, no communication at all... is it possible that our marriage is already useless? i don't have plans yet to be married again, but i was still wondering what if i want to be married again is it possible that i can re-marry another guy with no need to file for annulment?

thank you and hope to hear a good result.

This understanding would have been correct based on Art.83 of the Civil Code. but it was superseded by the Art. 41 of the Family Code as stated;

Art. 41. A marriage contracted by any person during the subsistence of a previous marriage shall be null and void, unless before the celebration of the subsequent marriage, the prior spouse had been absent for four consecutive years and the spouse present had a well founded belief that the absent spouse was already dead. In case of disappearance where there is danger of death under the circumstances set forth in the provisions of Article 391 of the Civil Code, an absence of only two years shall be sufficient.

For the purpose of contracting the subsequent marriage under the preceding paragraph, the spouse present must institute a summary proceeding as provided in this Code for the declaration of presumptive death of the absentee, without prejudice to the effect of reappearance of the absent spouse. (83a)

all laws are published in newspapers before effectivity.

Other than newspapers, there are many ways to know about your inquiry. Halos lahat nasa world wide web na, you just need to search. Anyway check these two links, it will help you a lot.
