iswitchl, the case is not about support for her but for your child.

north, you can still file a case for economic violence

Hi, i have a question. Is there a chance that i get a child support from my son's father? I was 7 months when i went to the united states to give birth to my son who is now 2 years old. His father left me when i was 2 months pregnant. When i went back to the philippines after giving birth he asked for another chance and so i got back withhim. I stayed with him for less than a year but cheated on me again. Its been more than a year since we stopped communicating and now hes expecting another baby with his wife, the one he cheated on me with, they got married months after we broke up. I am now here in united states and would like to ask if i can file or i have the rights to demand a child support from him? My son is 2 years old and i never had any support from him since even we were together. He didnt sign his birth certificate since he was born in the states and he wasnt there. He does not carry his last name though he looks exactly like him. i spoke to his parents but they stopped communicating due to some arguments with his mother. He left philippines with his wife to go to Bahrain with his parents but went back to the Philippines after few months.

I know that he has a business with his wife now but he doesnt consider it as a job. Thats why he claim that he doesnt have one. By that, he can say that he can't give any support?

Please let me know what can i do and my rights. Thank you.

If he say he doesn't have any income, how can e support his wife and baby? So he can support them and not my son?

Please let me know what can i do and my rights. Thank you.

gudevening po..my problem is almost the same as to imamom..got separated tho not legally last 2007.my 2 kids are with me then.altho he snt monetary support but not enough..last 2009,he got back to us and ive accepted him alang2 sa mga anak.he went back to us with a good job but he said he was so broke and no savings at all.he sends money paminsan, but most of the time wala, since i have a business then ok lang..ive accepted him kahit nakita ko laht ng mga nude pictures and sex vdeos nila ng kinasama nya during our separations.kahit nagiba na ang behaviour nya.altho sabi nya tapos na sila nung girl, nagpapadala pa rin ang girl ng mga vdeos n pictures sa mobile nya and they still have communication.and worse may isa pang girl na pinapadalhan nya pera..until things didnt work well for us,lagi na kami nagaaway..we got separated again.for 2years now, and until this day wala pa rin sya suport for my kids, puro pangako lang, pagdumarating na ung date na need na ung pinangako nya di na sya makontak..sa ngaun sa mga txt nya sinabi nyang may pamilya na xa may anak na sila.lumalaki na mga anak ko at malaki na rin gastos sa schooling since nsa private school sila and i dont have a job right now,we only depend sa natitira pa naming savings and a help from my siblings.
kahit anong text namin sa kanya at calls di nya sinasagot.
may laban ba ako sa child support kahit pa sabihin nyang kulang pa saknya at sa pamilya nya ngaun ang kinikita nya?
tnx

pwede po ba magpadala ng demand letter na ipanotarized lang sa atty na di na need dumaan sa mahaba at magastos na proseso?
valid ba yung demand letter with atty's notarized?
pwede ko rin ba ipaalam sa employer nya ang issue at idemand na kung pwedeng direct na ipapadala sa mga anak ko ang part ng sweldo nya?

Good day Attorney.

yes, you can file that case, but as an answer to your question, there will be no new case by mere failure to attend.

My ex makes 15k monthly, we had 2 sons, i currently dont work. im requesting for child support but what would be the suggested amount i can ask for child support from him? Also what if he loses his job? does he have to still keep providing support or will he be able to not provide support when he becomes unemployed? Thanks

he is required to provide support based on his capability. failure to do so is economic violence uner vawc law.

attyLLL,
i have the same problem like of imamon, ganun na ganun po.lagi nya sinasabi na ang kinikita nya kulang pa sknya at lagi nagkakasakit ang baby nya sa bago nyang asawa daw at asawa pa daw nya nagpupuno ibang pangangailangan nla, when actually he has a job, territorial sales and farm manager, how come he keep on telling us wala xa sweldo, thru commission lang xa kumikita at allowance.pero dipo ba obligasyon nya pa rin magsustento sa mga anak namin since nsa hiskul na preho kids ko and im having a hard time with our daily expenses moreso with their schooling.
