My common law husband left me for another woman and wants the custody of our child, 5. What case can I file on them both? And to take my child away from his family.

you mentioned common law, meaning not married, and the child was 5. by law, the mother has ALL the rights to the child. you cannot file a case, unmarried nga eh.

In rule with illegitimate child, the mother has full parental authority. though the father has right to visit the child/children.

go to the dswd or pnp women's desk nearest where they live and ask assistance in getting your child.

You are the common law wife (to be clear).

You can file a case for Vilence against Women and Children and seek a temporary protection order to keep your ex-bf away from you and your child. Anyways, because the child is 5, under the law, the child SHOULD be with the mother.

File a Habeas Corpus case to get custody of your child. You can also file a case of RA9262 against your bf.
