Dear Atty,
Yong kinaso ko sa husband ko last Aug. 10, 2010 ay RA 9262 then the judge dismiss the case dahil po nagkaroon ng MOA. After ng MOA masigasig ang husband kong sundin ang agreement especially sa economic support at bukod pa yong pambayad sa school. Sa MOA nabanggit ang word na tuition fee. Bali ito ang hindi nya sinunod ang pag bayad ng school fees ng kambal namin na both college. Hindi kasya ang monthly support nya kung doon pa kunin ang kalahati mambayad sa school kasi tuition fee lang raw ang naka emphasize sa MOA. Pwede pa ba ito i file ng " motion for writ of execution" dahil ginaganito nya ang mga anak namin isa 4th year Pharmacy at yong isa ay 3rd year BS Psycho. Seaman po asaw ko at malaki ang income nya kasi maka uwi po sya ng 20 k dollars at kahit sa lupa sya tuloy ang monthly support na 100 % basic nya. Kaya napa gastos ng Pharmacy ta nkadorm pa ito ang anak namin dahil sa malayo ang bahay namin sa Legarda.

file a motion in court for execution of the MOa, if it is possible.

Bakit po parang d po kyo sure kung possible pa ang motion o writ of execution. May duration po ba ito. Ayaw k ma technical sayang ang pera sa docket kung d nman sigurado. Kaya nga po nag tatanong kung possible pa ba ito.

i say 'if it is possible', because i am not sure what the facts of your case are. there should be no docket fees required.
