mangyari po sanang makahingi ng payo sa inyo

Di pa po kami kasal ng GF ko pero may 1 y.o po kaming anak. Wala namang maltreatment on my behalf to make her leave, just so happened na mas gusto nyang sumama sa barkada at magsaya kaysa maging ina sa aming anak.

Live in po kami and yun nga mag-iisang buwan na syang walang paramdam sa aming mag-ama, maski sa parents nya kung saan hindi nya sinasabi kung nasan sya at kung san sya namamalagi, minsan nag-tetext sya kung saan kinakamusta nya ang anak namin maski ang magulang namin.

Until i found out na pinasok na rin nya ang mundo ng pagiging PSP (personal service provider / Escort) para masustain ang kanyang pamumuhay at makapagpatuloy ng kanyang pag-aaral.

With that, gusto nya that someday na huwag ipagkait ang bata sa kanya. Wla naman akong balak ipagkait ang bata sa kanya pero sa sitwasyon naming ito na halos ako lahat ang gumagawa para sa aming anak, hangad ko sana magkaroon ng full custody sa bata at hindi the other way around.

Kasi alam ko kahit anong mangyari sa ina pa rin ang pabor ng batas sa mga sitwasyong ito, pero natatakot ako na baka maapektohan ang bata sa paglaki nya since ang ina nya ka po ay pumasok sa escorting... at the same time hindi nga po nagpapakita sa aming mag-ama maski sa kanyang mga magulang.

any advices po ba? may mga malapitan po ba akong lawyers dito para makatulong sa akin...

Reclusion Perpetua
Although the mother has the full parental authority over an illegitimate child, that rule in not absolute. providing a “convincing reasons”, that right can be strip off from the mother. Same rule with a child under 7 y/o.

try to see a lawyer to study your situation.

moderator
i recommend you consider filing a petition to be declared the guardian of the child. that way you have legal basis to have custody and she'll be required to take court action to enforce her rights.

ask ko lang even if nakapangalan po ang apilyido ng bata sa akin i still have to file for the said petition for guardian of the child?

almost 1 month na hindi nagpaparamdam ang mother eh ... sabi naman ng parents nya na sa akin muna ang bata since ako naman po ang ama...
