My friend bought a parcel of land through a Deed of Absolute Sale 8 years ago but failed to register the same. Then just this year my friend learned that the said land was registered already under the name of the child of the seller(now deceased) in 2010, the child was one of the witnesses in the said Deed of Absolute Sale.
What is the remedy of my friend, is it through court process? by filing what kind of complaint? is it for cancellation of title or reconveyance or quieting of title? Is it correct that the ground would be fraud in obtaining the said title?
