may inaalok po na lote sa akin. ung katulong at kanang kamay ng mag asawang me ari po ang nagbebenta sa akin, pareho po sa america na nakatira ang mag asawa kung kanino nakapangalan ang titulo ng lupa. ano ano po ba dapat kong hanapin papel sa kanang kamay nung me ari? sabi nya me SPA dw sya...sapat na po ba ang titulo lang ng lupa at SPA lang eh okay na at pwede ko ng bilin ang lote na binebenta sa akin? ano po ba ang extrajudicial settlement of estate?..pati po mga anak ng me ari ng lote, nasa america na din daw po....need ko pa bo ba manghinhi ng extrajudicial settlement of estate?

SPA is enough , if they have SPA it means the owner give power to that person to sell his/her property (Authority to Sell will do also)

Dapat na ipakita nya ang SPA / Authority to Sell kung talagang authorized syang mag benta ng lupang yon

wag kang bibili ng lupa sa isang tao na walang spa dahil yan ang proof mo na legal ang inyong transaksyon sa tunay na me ari ng lupa.. make sure din na buhay pa ang. mag-asawang me ari ng lupa dahil kung patay na ang isa sa kanila ay mangangailangan ng exttajudicial settlement kung saan dapat ay mailipat at mahati-hati sa pangalan ng surviving heirs ang pag-aari ng lupa upang sa gayun ay malinaw kung kaninong anak or asawa nakapangalan ang me ari ng lupa na gusto mong bilhin. dapat lang din na ang nakapirma sa spa at land title ay iisang tao lamang.

Please check the original SPA it should be notarized or consularized since the owner/principal is abroad. Then read the SPA, the agent/attorney in fact appointed in the SPA should be authorized to sign the Deed of Sale and receive payments and make sure that it is indeed the agent who will sign the Deed of Sale. Also ask them to annotate the SPA in the title.
