1 processes after a vehicular accident on Fri Sep 14, 2012 4:27 pm

Arresto Menor
attorney, my car was bumped by a jeepney on its right side damaging almost all of the right side while I was crossing a road while the green traffic light is on.
the police responded to the scene, took pictures, got our documents and brought us to the precinct. we, both drivers gave our sworn affidavit and the investigator questioned both of us.
the police said there are only two ways on how to end this, case filing or settlement. the police said I am the victim here since my car was bumped on its side.
however, the jeepney driver doesnt want to talk and settle, saying just pursue with the case.
so attorney, what can I do about this for me to claim something for the repair of my car?
i already have the police report, pictures, copy of jeepney driver's license and docs. I do not have a Comprehensive insurance, so I am doing the leg work.
How can I claim from the driver?

either a civil claim against the driver and the owner through a small claims case (rules on

or file a criminal complaint at the prosecutor's office with assistance of the police
