Hi Attorney. I have a concern about my Redundancy Pay from my previous company. Legally speaking how long should i wait before I can get my Redundancy Pay? I've been waiting for it for almost 2months already. It's a BPO company and we were put under floating status for 6months. We signed the papers stating that after 6months of being under floating status we are entitled to receive our Redundancy Pay. Please help.

Pagkakaalam ko bawal ang floating status for more than a month. After one month lalo na kung di ka suspended dapat macocompensate ka na or dapat makakatanggap ka na nang sahod.

I honestly dunno kung illegal nga yun. Pero madami kame na naka-floating and nag-signed naman kame sa parang waiver na after 6months of being under floating stats may makukuha kame na redundancy pay. I just wanna know kung gaano katagal ba bago makuha ang redundancy pay. 2 months na kase ako naghihintay eh. Sad

hi, sana po matulungan nyo po ako. nagwowork po ako sa isang bpo company sa makati. ang account ko po ay ipupul -out na po dun sa bpo company ko ngayun. 39 agents po kami na nag wowork dun sa account. mga regular employees na po kami dun sa bpo company kahit na mawala po yung account namin. ang unang tanung ko po ay

1. may rights po ba kami na irequest nalang na bayaran nalang kami ng redundancy pay kahit na may available pang ibang account na pwede kaming ilipat?

2. may rights po ba yung bpo company namin na ilipat kami sa ibang account kahit na ayaw nanamin mag work sa kanila?

sana na po may ATTORNEY na makatulong samin dahil di na po namin talaga gustong mag work for that bpo company. ayaw po kasi naming mag resign kasi ang sabi po nila pag nag resign kami wala kaming redundancy payment na matatangap backpay lang daw.


iba pa po ba yung backpay at redundancy pay??

hi atty.,

i am an employee for 23 years, my boss was here for more or less 3 years. last year of nov. my boss started to take away my assignments one by one without written notice until by jan. of 2012 i was no longer working but still i come to office everyday and received my salary and other benefits. i was so confused because i know that i did nothing wrong because i haven't received any memo from him and right now i still come to office. am i on a floating status because i dont have assigments and if so can i ask for redundancy? thanks

ajavier, that may be considered constructive dismissal because they are trying to make your position unbearable and force you to resign.

however, you can discuss redundancy with HR as this can be a good way out. the alternatives are just to bear it or file a complaint at nlrc.

hoping to get a reply..


working po ako sa call center for almost 2years. ung account po namin is tinanggal ng company dahil hindi nagkasundo s bayaran. nong sept. 30 po un. pinag leave po kme ng 1 week using our VL/SL kase dw po no work no pay while waiting for new account. nagkaron po kame ng account. unfortunately, kasama po ako don sa mga hindi nakapasa. endorsed po ulit kame sa bagong account at don po kame nakapasa. ang kaso po ang training namin Nov. 12 pa. hindi po kame pinpapasok at pinapagamit po ulit samin ung VL/SL na natitira namin. kung maubos po un no work no pay n po. kase dw po floating status kame at hindi n daw nila ksalanan bkit hndi kame nakapasa sa unang acct.

pag floating status po b, no work no pay? tsaka more than a month na po kame folating since nov. 12 pa kame babalik, dpat po db may redundancy pay n kme?

moderator
the law allows the company to suspend the employment relationship for a maximum of 6 months during which salaries do not have to be paid. only after the 6 months will you be considered terminated for redundancy.

if however, there is continuous hiring, you can request for assignment to another position or you can file a complaint in nlrc for illegal termination or suspension.

ask po hawak ko po kasi ang isang division ng company nmen at lahat ng company property sa division na un sken naka account kahit hindi documented. tanong ko naredundant po ako at mukhang my possibility na ikaltas sa akin ung mga nawala at nasirang property ng kumpanya. pwede po b inyong mangyari at gaano po b dpat katagal ung pagprocess ng redumdancy pay? thank you
