Hi Atty.

Hihingi lang po sana ako ng advise, meron po kasi akong credit card sa BPI na hindi ko na nababayaran since 2010 dahil isa po ako sa mga na lay-off sa dati kong trabaho. Ngayon po, iba na ang employer ko at recently lang po ako na-employed. Pinag-open ako ng new employer ko sa BPI ng atm for payroll at during interview po sa bank nung nag-oopen acct. ako nakita po nila sa database na may outstanding pa nga po yung credit card ko sa knila. Tinanong din po nila ako kung alam ko yung status ng card ko... sabi ko naman po alam ko at hindi ko pa po nababayaran yung balance ko. Tinanong din po nila kung may province ako, sabi ko po meron sa aklan. Yun lng po at nakapag-open naman ako ng account, kya lang po nagwo-worry ako na baka kapag nagdeposit na yung new employer ko sa bagong atm ko sa bpi for my salary na bka i-debit po nila or bka wala na akong ma-withdraw kasi nga po may outstanding balance po ako sa credit card.

Good pm!I have the same issue.but this time its me and my husband who had a dismissed case (credit card non-payment) with BPI for sum of money. It was dismissed without prejudice last dec.2011 due to lack of interest to prosecute. my husband is now applying to a new company and will be asked to apply for a BPI ATM. is there any possiblity that BPI may refile a case against us?or can they freeze the payroll account even if the case is dismissed?please give me an advice on this.thank you very much!

Yes it can be possible try to read Lending Act medyo di ko kasi alam ang lending act but may possibility yun.
