Family inheritance issue.
Many years ago, the father of 6 children (they are now all in their 50-60's) and the step father to one child, passed away.
He left everything to his wife. She is the blood mother to all 7 children. The mother's name was Cosuelo.
When Consuelo died, she did not have a Will.
Now some of the children are trying to claim that the eldest, the child from the first marriage, should not be entitled to property, because it was not her father.
My understanding is that once the property passes to Consuelo, it then becomes 100% hers and in the absense of a Will to the contrary, the property should be divided equally to ALL the children.
The middle sister, is trying to claim Consuelo gave her large portions of the land, but there is NO documentation and no one witnessed this gift.
Does the eldest daughter has the right to an equal share and does the dominant sister have any rights to decide who gets what?

True! once its passed on to Consuelo it is 100% hers and all her children are equally entitled for equal amount of inheritance. You need to take the case to the right lawyer to deal with it! If there are no documentation that the large portion of the land was given as a gift, she has no right to claim it! even she has witness it has to be written to make it legal. And YES the eldest daughter has a right to have equal share and NO the dominant sister has no right to decide who gets what! the decision comes from their lawyer to have it divided equally. Wink
