Ang problem ko po ay ang paghingi ng aming Sales Manager ng cash tuwing meron kami hindi natutupad sa aming mga weekly goals. These are 'penalties'. For example: 1) P50 for every day late, 2) P100 for every day absent, 3) P500 for not meeting the 2 site trippings weekly, 4) P100 for every day na hindi nakakapagtext ng kung ano ang aming nagawa for the day, 5) P100 for not meeting the goal of 2 forms signed by clients weekly. (According to our Sales Manager, these are our proof kasi na we are actually working even if we don't have a sale, i.e. site trippings, signed forms. Aside po from the 9AM time-in sa office, hindi na kami required na magstay sa ofc, maski umalis na kami ay ok na.)
According to our Sales Manager, these are 'Penalties' that are imposed to us for not meeting our weekly goals. In turn, the Sales Director also imposes 'penalties' on him for not meeting the sales goals for the month, so pinapasa lang po niya sa amin yung 'penalty' scheme.
Hindi nakasulat ang mga penalties na ito sa 'Sales Contract'.
Is this legal? I'm thinking, hindi naman kasi kami talagang employees eh, so i'm not sure. Thank you po!!
