Pwede bang maging constructive dismissal evidence ang mga sumusunod:

1. I was berrated by my Boss infront of my colleague, due to differences in principle at work!

2. After the above incident, I felt I was being discrimanated, prior to the incident, I was a Management Team member, we met weekly with the Gen. Manager, but after the incident, my Boss did'nt allowed me anymore to be on the regular meeting, I was the only one left at my table, while the rest were having a meeting. This happened several times in the eyes of all the employees. I have a video/pictures of these meetings complete with the time and day when it happened, can I used these as evidence?

3. Prior to the incident I have my own staff, they report to me directly and goes that way for 8 years, but after the incident, he relegated some of my responsibility and transferred to my staff, he (Gen. Mgr.) started to meet with my staff directly. The reason he give me why this is necessary was, I'm not doing my job well. But I've been handling this position for more than 8 years, and I told him that I never heard complaint from Him, infact we have double digit growth during these years. He answered me back with " Tsamba Lang" infront of all employees. Pwede bang gamiting evidence ito for constructive dismissal?

ibig mong sabihin, may colleague ka na na mag e execute ng affid na pinagalitan ka? na may picture/video ka na nagmemeting cla? that you staff will testify for u?

story kasi is diferrent from evidence... Smile

Yes, had video of these, complete with time when, where, how it happened. All the events that transpired, like the meeting with my staff, giving directives directly to them, without my presence as their immediate supervisor. Just like demoting someone with no valid reason, except that we (the owner) dont share the same principle in work.

would this be constructive dismissal?

bpo setting:
-nilagay ako ng recruitment sa voice account, although wala akong experience dun.

-on the 5th month nagkataon ako yng highest sa scorecards at since nagkaroon ng open position for a senior position, nag apply ako.

-rejected ng HR yung application ko, sabi wala raw sa qualifications ko

-since pinatay yng objectivity, at needed ng 1 year tenure bago makalipat ng ibang department. steady lang ako sa work pero hindi na kasing stellar yng scorecards ko

-nagkaroon ng career development talk which was mandatory. so sinabi ko dun sa manager na kaya bumaba yng stats ko eh dahil na discourage ako sa pagbypass ng promotion sa akin. sabi ko rin na after 1 year palipat na ako sa tamang dept ko

-nagalit yng boss ko at sabi na i lack professional maturity. na dapat consistent pa rin dapat yng scorecards ko. kung magkakaroon raw ng opening ulit ay hindi niya ako i-eendorse at sisiguraduhin niyang 3 years ako as agent para matuto ng pagiging professional maturity

-sabi ko naman na hindi naman talaga ito yng position na inaaplyan ko pero para masaya lahat, aalagaan ko na ulit scorecards ko. pagdating ng 1 year magpapalipat na ako ng department

-my boss then said na hindi niya ako papayagan lumipat ng ibang department dahil baka mapahiya lang raw siya. at ok lang raw kung mag resign ako.

....does this not lead to constructive dismissal? ayoko naman sa voice/customer service department for 3 years na walang growth, lalo na this was not what i applied for in the first place. pero lumalabas na ang only option ko lang is to resign.

Hindi yta.

at alalahanin mo, kahit tumambling ka at umisplit, desisyon pa din ng may-ari ng kumpanya kung ipro-promote ka nila o hindi. magtayo ka ng sarili mong kumpany kung gusto mo ikaw lagi ang masusunod. bias kamo? hindi ka pa ipinapanganak may bias na sa mundo.
