good day po,

Magandang Araw Po.
Gusto ko lang po sanang idulog itong prolema ko sa naging boyfriend ko na naging ama ng anak ko. Ako po ay may anak ( Joanah Mariel Quiawan ) sa isang seaman na dati kong nobyo at mag 5 years old na po ang anak namin. Nag-aaral n po ang anak ko ngayon, sa 5 n taon ng anak ko, 4 na beses lang po naka bigay ng sustento ang seaman. Gusto ko lang po mag habol para sa sustento ng anak ko kasi po sobrang naaawa ako kasi di ko maibigay ang lahat ng kailangan ng bata dahil wala din po ako trabaho. Ni recognized po ng seaman ang birth certificate ng bata at pinirmahan niya yon. Naka apelyido po sa seaman ang anak ko.

Mam, sumulat po ako sa inyo kasi gusto kong humingi ng tulong para ma sustentohan ang anak ko. Yon lang po ang dahilan dahil sobrang kailangan ng anak ko ang tulong galing sa ama niya. Tumawag ako sa Delfi Shipping Agency ( Tel. No: 7084544 / 7084556 ) na xang agency ng seaman pero alam ko po na di nila sinasabi ang totoo n under pa nila ang seaman kasi sa facebook ng seaman ay cl ang nakalagay n agency. Sana po ma confirm nyo na under ng agency nila ang ang seaman mam.

Mam sana po ay kahit papano matulungan nyo po akong mahanap sa file nyo kung anong agency po b ang seaman na ang pangalan ay JONNIEFER QUIAWAN, taga Baliangao, Misamis Occidental po ang seaman. Sa pagkaka alam ko, last week ng November bumaba po ang seaman at sasakay ulit ngayong huling linggo ng December. Dati nag padala po ako ng letter galing sa abogado pero wala pa rin pong aksyon ang ginawa ang seaman. Binabastos po nila ako tuwing tumatawag ako sa cp nila. Alam ko pong maintindihan nyo ako dahil alang alang lang po sa anak ko n nag-aaral ang hinihingi kong sustento. Sobrang nahihirapan po ako sakaling i pasa namin ito sa abogado o sa korte. May trabaho po ako pero di po sapat ang kinikita ko para s amin ng anak ko. Sana po mam ay matulungan niyo ako kung paano ma-hold ang seaman para panagutan niya ang sustento sa anak niya.

Umasa po ako mam sa inyong kasagutan. Maraming salamat po.

options:
1. kausapin ng masinsinan si father (kung maaari, magmakawa, hindi dahil nasa mas mababa kang posisyon, kunng hindi, dahil na sa kapakanan ng anak mo)- i believe this is the better option
2. irelamo mo sa kinauukulan, like, brgy, OWWA. Hinay-hinay lang ksi ang problema nito kapag nawalan ng work si father, wla din sustento si child). Court,should be the last option. hindi lang sa dahil medyo matagal ang magastos (imagine, yung lawyer's fee ninyo e dapat sa bata na lang ibinigay) ang proseso kundi, medyo maliit pa mag-award ang court pagdating sa support.

Sa totoo lang po, ayaw po talaga anming humantong diyan ang pag hingi ng sustento... NAgpapakumbaba po talaga kami, pero puro nalang xa pangako sir. Sabi niya tatawag daw xa pag baba niya, eh naka baba n pala xa nung last week ng November, at nalaman namin sa iba pa sir. Ngayon tinawagan ko dahil nakuha ko ung no. nya sa facebook friend nya. Nang malaman nya n ako yong tumawag, di ko n talaga sya ma kontak. Sa bata lang kasi yong habol namin, mag 5 years old n ang bata at nag scul na... 4 times lang po syang nakabigay sir.

edi ipabarangay mo. at saka miss, hindi mo dapat ilagay ang name ng minor mong anak, wawa naman siya.... pwede naman natin itago sa pangalang "baby girl" diba?
anywayz, daanin mo na lang sa lambing si ex BF. hindi ka namn niya seguro tetesbunin kung hindi ka niya minahal diba? alam mo naman ang mga boy, madali lang naman yan mauto ng girl....

Anyway, same boat kami ni espina pero I am working and the EX is working too. 4yrs na kme hiwalay, walang sustento. Meron bang way, yung madali lang sana, yung makakaltasan na lang yung sahod niya buwan buwan, by law, para iprovide sa bata? Me ganun ba? Yung madali lang sana?

bawal kasi ang automatic deductions sa sahod. may mangilan-ilan na exceptions gaya ng sss, gsis, para sa union, pero itoy nakasaad sa batas) so, genrally di mo mapipilit ang kumpanya ni ex love mo na decuct-kan ang sweldo niya. ang way lang na alam ng maliit kung utak ay kung may order ang court, which, very unfortunately... required na mag file ka ng kaso sa court....at very unfortunately again, magastos..

so, try mo na lang dalhin si baby ke ex love mo this december at ipakilala mo siyang NINONG ni baby. baka magbigay kasi krismas naman ngayon. meri krismas

Hehe, kilala naman po ng baby ko dad nya. He left when she was 4. Ang hirap naman to battle human rights, parating me kadugtong na 'magastos'. San na ang hustisya? Para sa mga mayayaman? Nakakalungkot.

Seaman po ang ama ng anak ko, medyo ilang beses n din po xang nakasakay, Tama po b n mag demand ako ng 15,000 a month or more? Kami lang kasi ng anak ko, still single p rin po ako.

Yong 4 years n di xa nag papadala sa amin pwede po b akong mag habol sa mga taon n yon sa kanya?

Sakali pong malaman ko ang agency ng seaman, pwede ko po bang i directang ipadala dun ang demand letter, wala kc xang feedback sa unang demand letter n pinadala namin sa kanya atty.

Umaasa po ako s inyog response n alam ko makakatulong sa pagawa ko ng hakbang ngayon.

malalaman mo lahat ng sagot sa tanong mo kapag dinemanda mo na sya! court ang mag order kung ano ang dapat nyang gawin at kung magkano ang dapat mong tanggapin! kaya umpisahan mo na ang paghabol! Wink

How can this case prosper if the lady claiming to have support is not his legal wife? Would the case support pendente lite prosper?

If, for example, a couple had separated legally or the marriage was set aside, one of the spouse's may request spousal support or child support. In some cases, a judge may then create a support order to ensure that the spouse’s living expenses and their children can be met while the separation process continues. In this wise, pendente lite shall prosper.

While there is no question that the law ponders on the support on legitimate child, can we find support in the law for the illegitimate child by having his putative father to support both of them?

The answer should be qualified. If the putative father acknowledges the child by his conduct, acts, and other implied acts, then he may be bound by the court. How can the court bind him to his obligation if the former has no sufficient evidence of claiming that the father acknowledged his son? After all, The putative father might rebut the claim, notwithstanding his refusal for some reason. Can we fight for it?

I am not sure if the court will find sufficient ground for support pendente lite if the adverse party is not his legal spouse.

Paano ko po ba malalaman kung anong agency ang seaman? nag punta n kc ko ng POEA pero tinanong po ako ng POEA kung anong agency ang seaman, eh yong nga po ang dahilan kaya ako nag tanong...

MAy paraan po ba n malaman ko kung anong agency ang seaman??? Anong ahensya po ako ng gobyerno pupunta.

Inuumpisahan ko n po kasi ang pag palakad ng kaso against the seaman...

ms espina, your child has a right to be supported by his father. file a case for support and/or a case for RA9262 on the ground of economic abuse. a child whether legit or illegit is entitled to support under our Family Code. go to the public attorney's office where you are a resident for a free legal representation.

Too many questions! have you read her full story carefully?
She did mentioned that the seaman has signed and recognised the child birth certificate!

"Ni recognized po ng seaman ang birth certificate ng bata at pinirmahan niya yon. Naka apelyido po sa seaman ang anak ko."

Technically, she may not be married to this seaman but he signed and acknowledged her child, therefore he is obligued to give financial support and should not ignore or cannot get away with his obligation to his child.
And yes! every child, legitimate or illegitimate has right for financial support under Philippines law! kaya kahit bastardo pa ang mga bata it is their biological father's obligation to support them financially!

My question has been answered in the recent case of BEN-HUR NEPOMUCENO,
vs. ARHBENCEL ANN LOPEZ (No. 181258, March 18, 2010), the only technical problem found by the court is ung signature ng putative father sa birth certificate.

The Court held that:

The Court is mindful that the best interests of the child in cases involving paternity and filiation should be advanced. It is, however, just as mindful of the disturbance that unfounded paternity suits cause to the privacy and peace of the putative father’s legitimate family.

reply: Go to POEA in ortigas,Madaluyong City and go to CENTRAL RECORDS DIVISION im not so sure which floor but you can just ask the guard which floor.From there you will ask for a copy of Overseas Filipino Worker Information Sheet of your husband just present your id,your marriage contract to the guard in charge in order for you to have the form that you gonna fill up..
