13th Month ng Resigned Employee, Pwede Po Bang I Demand in Advance Separate Sa Final Pay?

Magandang umaga po. Sana matulungan nyo ako sa problema ko.

Nag resign po kasi ako at ang effectivity ay November 20, 2012. Ipinasa ko po yong clearance ko, fully accomplished at cleared naman nong December 11, 2012. Ang policy po ng company ay ibigay ang final pay 45 days after.

Hiningi ko po na sana ay mauna nang ibigay ang 13th month dahil ang due naman non ay on or before December 24, 2012. Ang sabi po nila hindi daw pwedeng maunang ibigay yon dahil kasama yon sa final pay at ang cut off nila ay Nov 30, 2012.

Tanong ko lang po, pwede ko po bang i demand sa kanila na mauna nilang ibigay ang 13th month ko separate sa Final Pay ko? Kasi po kung isasama sa Final Pay, malamang last week of January 2013 ko na makukuha yon. Kailangan ko po kasi yong 13th month dahil mula nong November 30 wala na akong sweldo at maraming pagkakagustusan itong Disyembre.

Hindi ko lang po alam kung may topic ng similar dito. Sana po ay maliwanagan nyo ako tungkol dito.

As per implementing rules:

The payment of the 13th month pay may be demanded by the employee upon the cessation of employer-employee relationship. This is consistent with the principle of equity that as the employer can require the employee to clear himself of all liabilities and property accountability, so can the employee demand the payment of all benefits due him upon the termination of the relationship.

Good morning, may question din po ako. nagresign po kasi ako last october 12 po. nag turn over po ako ng 1 month and october 12 po effective date ng resignation ko. after 2 months pa po sinign ang clearance ko ng accounting. ilang months po ba dapat ang nasa batas sa pag kuha ng last pay?

Wala.

Pero dapat "within reasonable time" - so ask them ano ang expected release date. Then if it's too long for you, or if there is a delay, then ask for clarification. If there's no valid reason for the delay, then make your complaint.

Good day po.

Gusto ko lang pong magpasalamat kay council sa ibinigay na paliwanag sa tanong ko.

Nakuha ko po ang 13th month ko before December 24, 2012. Nakakatuwa nga lang pong isipin na ang ganito kalaking kompanya na dati kong pinagtatrabahuan ay di alam ang ganitong batas, na pwede palang kunin in advance ang 13th month pay separate from the final pay.

At least now alam na nila. Smile Maraming maraming salamat po.
