Good day po,

Namatay na po tatay namin, 5 kaming magkakapatid na naiwan niya, buhay pa nanay namin, legally married sila ng tatay ko. Yung kalahati ng house and lot ng family namin sa QC na may bakery business ay inangkin na ng panganay namin kasi daw siya na ang namumuhunan at naglabas siya ng pera nung pa-lugi na ang bakery.

Based po kasi sa napag-aralan ko dati sa tax namin nung college, dapat yung kalahati ng property ay mapupunta sa mama ko, at yung other half ay paghahatian namin equally ng nanay ko at mga kapatid since walang last will ang tatay ko. Kaso mukang hindi papayag yung kuya ko, kasi pinagawa at pinapaganda na niya yung kalahati ng house and lot na inangkin niya, yung kita ng business ay 100% sakanya, bawal kaming kumuha ng kahit ano sa bakery ng walang bayad. Nananakit siya pag kumukontra ka sa gusto niya. Yung ibang kapatid ko ay kampi din sa kanaya. Gusto ko sana ipa-settle sa korte gusto ko po sanang malaman kung magkano magagastos namin sa judicial settlement?? Thanks in advance.

depende yan sa abogado at sa magiging hirap/kadali ng kaso. pwede kaung dumulog sa PAO pero depende pa din yan sa totoong sitwasyon ninyo kung tatanggapin nila.

pero pare kung balak ninyong gumastos sa abogado, nagtataka naman ako at ayaw ninyong magbayad ng tinapay. mas mura naman yata ito.

hindi tinapay pre.. yung karapatan sa property ang habol namin.. gusto ko lang nasa tama ang lahat, walang manlalamang..

gusto ko makuha kung ano yung dapat samin ayon sa batas..

depende pa din yan sa kung gaano kahirap o kadali ang kaso at sa abogado.
sa pagkakaalam ko kasi bago magsabi ng halaga ang tunay na abogado ay dapat napag-aralan niya ng maigi ang kaso. yon kaso mo kasi, although sinasabi mo e house and lot, e parang simple lang... pero may pagka tricky. bakit ko nasabi? hindi mo na kenakailangan i judicial yan ganon lang kasimple. point is,

komonsulta ka personally ng lawyer. potokapi mo na lahat ng dokumento mo.

wag kang umasa, na may mag ro rough estimate dito. baka ang magkapag-advise sa iyo e engineer, kc sila ang nag-ro-rough estimate

maraming salamat po sa advice.

tingin ko po ay kailangang i-judicial kasi napaka-labong magkasundo kami ng kuya ko. gusto niya sa kanya lahat dahil siya na daw ang namumuhunan sa business.

mejo mahirap makuha mga documents kasi kuya ko ang may hawak ng mga ito.. siguradong hindi niya ibibigay. sa pagkakakilala ko sa kanya, sisirain muna niya lahat ng papeles at dokumento bago ko makuha.. siguro NSO copy nalang..

it depends on the value of the properties. it could go as high as 100k. you are correct in saying that half of the property of your deceased dad must go to your mom and the other half should be equally distributed between your mom and yourself and your siblings. with regard to the reasoning of your brother that the bakery shall be solely given to him is not correct. under our law, before any share of the heirs could be distributed, all the debts or obligations of your father or the deceased must first be settled/paid. since, your brother paid for the renovation and other improvements of the property of your dad it could be said that he can be considered as a creditor, therefore, payment of the value of his expenses must first be settled. after that if, there are no other creditors that would surface then you can now settle your share even extra-judicially.

sobrang thank you attorney man and attorney pedro. susubukan kong isuggest sa kanila na bayaran nalang ng business yung ipinuhunan niya para maiwasan ang gulo. pag ayaw talaga, judicial settlement nalang. Thanks!
