Paano kung nag-send nga ng back to work notice ang isang kompanya pero natanggap siya ng empleyado 2 linggo matapos siyang materminate? Kung tama ang basehan ng termination, pwede pa rin bang mag-file ng kaso dahil di nasunod ang procedure? Anong kabayaran ang pwedeng hingin ng empleyado?

sorry po! tama po kayo, naisip ko lang nung una na baka sobrang haba at komplikado na.

di ko na po alam ang eksaktong bilang ng lates at absences ko dahil wala na po akong access sa attendance records namin pero marami-rami na po. nakatanggap na po ako dati ng written warning. pero di ko pa po nararanasan ang suspension (susunod na parusa).

ilang buwan ang nakaraan para po akong nakaranas ng minor depression kung saan matagal akong di nakapasok. di ko po nainform ang aming supervisor dahil di ko rin alam kung paano ipapaliwanag sa kanya kung ano ang nangyayari sa akin.

pag tinatanong po ako ng mga dati kong teammates kung babalik pa ako, laging oo ang isinasagot ko sa kanila. bago po ako bumalik, naisipan kong hintayin muna yung back to work notice para malaman kung ano ang mga kailangan kong sagutin at ano ang mga kondisyon sa pagbalik ko sa trabaho. napakatagal po ng nasabing sulat. nalaman ko na lang sa dati kong kasama sa trabaho na terminated na pala ako. natanggap ko yung btw notice 2 linggo matapos ang date of termination ko.

sa termination letter na aking natanggap, nakasaad na tinatanggal ako sa trabaho dahil sa 1. abandonment of work (situations where the employee does not notify the approving authority about his absence and no longer returns to work despite the directive from the company to report back to work), 2. abandonment of work for regular employees (accumulation of 3 consecutive working days total of unauthorized/unexcused absences), at 3. gross and habitual neglect of duty (dahil daw sa mga awol's ko).

yung sa unang reason po di ko natanggap yung btw notice bago ako materminate, sabi nyo po dun sa pangalawa masyadong harsh at mali yung policy, yung sa pangatlo po di ko po sigurado kung pwede nilang ipataw sa akin ang parusang termination kung di ko pa naranasan yung mas mababang parusa na suspension.

maaari po ba akong magreklamo sa ginawang pagterminate sa akin? ano po ang pwede kong hilingin mula sa dati kong pinapasukang kompanya? salamat po sa pagsagot nyo sa aking mga tanong!

yes, but you should act quickly by filing a complaint at nlrc. it will negate the implied intent to abandon.

ang totoo po niyan, march pa ako naterminate. nung natanggap ko yung termination letter, ipinakiusap ko po sa kaibigan ko na isang officer sa pinapasukan kong kompanya na sabihin sa HR na late ko na natanggap yung btw notice pero di naman po sila nabahala. pumunta rin po ako sa HR para ipaalam sa kanila ang nangyari pero bale wala lang po sa kanila. wala po akong masyadong alam sa labor laws kaya tumahimik na lang ako. kailan lang po ako nakapagbasa-basa tungkol sa batas dahil sa nanay kong napasama sa isang vehicular accident. dahil dito, naisipan ko pong mag-research na rin tungkol sa kaso ko.
