if you file a case, it can be leverage to get clearance, but the danger is the more that they will refuse to give clearance and backpay

hi. i used to work for a BPO industry, i worked there for 8 months, i resinged due to haelth isues Im done with my clearance and all that. One of their staffs told me that i need to go come back after 2 months to pick up my check. 2 months later, i went there to pick up my check, only to find out that they dont have my records at all. they keep asking me to talk to hr and finance, but when i talk to them, all of them are pointing fingers. Until one day, one of the finance staffs told me to do the clearance all over again and wait for another 2 months. what is the legal action that i need to take?

Thanks!

Hi Atty... Is there a legal timeframe how long will be the issuance of your backpay? My case is almost the same as rockie_15.. Though in mine, after 4 months.. I was advised na negative pa daw ang backpay ko.. I was hospitalized before I resigned.. I have an approx 8 months of 13 month pay.. Im a regular employee.. I was only absent for 3 or 4 days.. and they said that they are deducting 10 days... What will be my step in filing a case against them Atty? As a backgrounder... Madami na pong different cases na nag file sa nlrc against this company....
