Good Day,

6 years po akong employed sa isang private company, Binigyan po ako ng 2 option..

Termination or forced Resignation

Ang reson po ng admin ay lates at absent pero po walang po akong narecieve na memo about my lates, at lahat ng absent ko po ay nakafiled as a Sick leave or Vacation leave at pirmado ng mga project Managers

Nang bigyan ako ng 2nd chance ay my pinappirmahan sa aking agreement, Puro personal ang laman ng agreement at walang kinalaman sa late at absent ko.. lumalabas na pinepersonal lng ako ng top management abt sa isang pang empleyadong ex girlfriend ko na di maganda ng hiwalay namin na malakas po sa employer..

Babayaran daw ako ng 2months for my resignation.. Ang gusto ko po sana ay bayaran ang years of service ko + 13month this year + SL & VL nasa batas po ba to?

pag resignation.. yung pro rated 13th month pay lang + SL/VL..

wag ka pumayag.. pag ni terminate ka.. file ka nang case sa NLRC..

I was forced to resign last January 11, 2013. Ang case, mismanagement of Credit Facilities, Breach of Trust and Confidence.

Wala po kasing due process, considering i am a manager. The first issue was, Yung Credit Line namin with the banks was mis managed apparently. So maraming utang ang kumpanya ngayon sa mga bangko . The loan line was used for Domestic Letter of Credit na ginagamit namin sa mga suppliers. The problem was naipit yung pera sa suppliers because hindi pa complete ang payments but now the goods were already coming after ma settle yung balance.

Now, second case. Me and my production manager, receives a monthly sales commissions multiplied by the number of products we sold every month. Last December, we sent a computation to the approver together with Check Voucher and Checks amounting to Php 56,000.00 each for a total of Php 106,000.00 to which the owner signed. But I held the encashment since there was no funds available for it. However, this accounting staff approached me to tell na there will be a short fund in one of our bank and need to be funded amounting to Php 10,000.00 and it so happen that i need a cash that day amounting to Php 25,000.00 to be given to a client as a "gift". The owners agreed that we will give the client that money as a "Xmas Gift".

Now, this accounting staff who happens to be a cousin/relative of the owners, told me or suggested to me that they will encash the first check (Php 53,000.00) to cover the Php 25,000.00 and the Php 10,000.00 to be deposited to that bank. After Christmas, I asked that accounting staff to withdraw the remaining checks because its holiday and i need money. I didnt told him that i have the intention to returned that money after the release of our sales commission.

On January 09, 2013, he texted me that the owners are looking for the checks. I was surprised and told him to give alibis because i have no money yet to return. Then little did i know that the cousin already informed them na na encashed na yung checks. I was asked to report to the office last Friday January 11, 2013 and immediately handed over to me the resignation letter signed by them. That resignation letter was made November 2012. I made it for all my staff to challenged them to perform better, and if in the span of three months and there is no improvement, we can voluntarily resigned from our respective positions.

There was no due process whatsoever. What are the chance of filing a civil case against me?
