good day! ask ko lang po sana kung pwede bang ma e ammend ang amicable settlement kung ang napirmahan ng complainant ay hindi ayun sa pagka intindi nia?

It depends, if the other party agrees to do so. If not,such amicable settlement constitute a CONTRACT and it is ENFORCEABLE.

Arresto Menor partner and his wife made an amicable settlement sa MSWD.they both sign and agreed that they are seperated and no strings attached.the wife agreed so but after 5 years now.she wants to sue us...i dnt understand,wala bang basihan ang pinirmahan nya na hindi cya mangugulo?

jean, such an agreement is considered immoral and has no legal effect. however, you can use it as a defense that she consented to your being together.

eline, technically it's possible, but it's very difficult

ganito po kasi yun atty,ang pinirmahang amicable settlement sa barangay ay "Sakaling may titira sa bahay na iyon ay dadaan muna sa paguusap ng parehong partido kung okey sa kanila bago pwede tumira ang isang tao o pamilya" pero ang bahay po na iyon ay may mga paupahan at may mga nakaupang tao na bago paman magkagulo ngunit hindi nabangit ng complainant na may mga renters duon. kasama po ba sila sa sinasabi sa amicable settlement na kelangan pang dumaan sa approval ng 2 partido? kasi po ang pagka intindi lang ng complainant ay ang dadaan lang sa approval nila ay yung mga parating palang o bagong titira at di kasama yung mga dati nang nakatira dahil nga po sa salitang SAKALI which means parang hindi pa tumitira dun sa bahay na iyon. Please help us to clarify. Thank you.
